California- admittedly some of the measures here have been extreme, but LA didnt turn into NY so I'm grateful for that. Once the virus took hold though it was pretty obvious that the rural areas were going to have it a lot better. Tbh I much rather would have spent the last 5 months in East TN. My parents are in Knoxville so it was tempting. City life is pretty freaking lame during a pandemic

I’m sure you mean that to apply to both people that have wronged someone and those that are looking for someone to blame when they should be looking in the mirror or moving on. The problem is that now people think every accident is a payday opportunity and there are juries giving ridiculous awards to punish corporations, sometimes even when the facts of what actually happened are on the side of the defendant. The trucking industry has a huge target on its back right now. Once a verdict goes over $1M, the average verdict from accidents involving trucking companies in 2010 was about $2.3M. The average verdict for claims over $1M in 2018? $22.3M! Well, $22,288,000 but you get the idea. It’s out of control.

Your stats are meaningless without an examination of injuries.

Juries are tougher than they have ever been. I've had potential jurors tell me they would never award pain and suffering. And fwiw, every plaintiffs attorney would gladly try injury cases in front of a judge because the judgments would be significantly higher

On some level you are correct but it’s safe to assume that any claim going over $1M involves pretty serious injuries and/or fatalities. I think they (ATRI) even have stats on fatalities that show similar trends. Granted, earnings, societal impact, and more goes into death awards but there was a single death accident in GA from 2016 that resulted in a $268M verdict. We’re not talking about someone that made huge money either. That’s absurd. Then you get crap like the Werner claim from TX (‘18 I think?) that was completely not their fault yet they got slapped with a $90M verdict. While the damages do come into play there’s clearly a huge problem. You know who’s going to pay for all these nuclear verdicts? Us. And these are the ones that made the news. I know for a fact there are massive settlements that never come to light because they’re under gag order. This is a big reason the insurance industry is going nuts right now.

All I know is, for the fifty two years I've been doing it, I've never cut off the tip of my finger sitting in a damn folding chair. Someone who cannot operate a folding chair...well....
