I'm admittedly not a Constitutional scholar ...

... but a state government prohibiting a form of entertainment on public property, based on how the performers are dressed, could be interpreted as an infringement on their 1st Amendment rights, which protects freedom of expression.

I think in some part, if this is challenged all the way up to SCOTUS, it would run counter to 1A. I can see where local public decency laws would also be given consideration and be respected. SCOTUS does strike down some parts of laws and uphold others.

It's definitely interesting that the left is so furious that Tennessee, and Florida, want to stop the men playing dress up from being around children. If you notice, none of their arguments are about the men being able to Express themselves, or dress up like they pretend to be, not one single one. It's only when they're restricted from being around children, that's when they start threads and make comments on any social media.

It's because the supporters of this bill clearly don't give a f*** about the kids. It's a tastlessly veiled way of *****ing on the q**er community.

If it were about the kids, cursing would be illegal on public property. Thongs would be illegal on the beach. Street preachers would be banned on street corners. Any street performer singing about pg-13+ matter would be illegal.

I agree with you 100%, but I'll challenge you to show me a thread, or even a post by anyone on the left that had an issue before state government banned it from schools, or near schools.


Edit to say, while i agree that the government shouldn't tell people how they should dress. I'm in agreement about keeping mentally unstable people who play dress up away from children. You can't make fun of people and call them anti science over covid stuff, then argue that a man in a dress is a woman.

Regarding McNally, it would be nice if elected officials actually believed in what they stood for,but that's a lot to ask of them no matter what side of the aisle they're on. In an ideal world, it would be nice. That's politics in a nutshell. A lot of hypocrites and sellouts.

The part that the deranged leftists gloss over or leave out is that it is sexualized performances being exposed to children is what is being targeted. Adult cabaret. That is what the legislation is aimed at, not some dude that wants to play dress up. The leftists are just using it to promote their made up narrative that the right is bigoted. I think if you can ban strip shows, you can ban drag shows.

This law is being unnecessarily complicated by the left to make a point. It won't be that complicated to enforce. Drag shows are pretty obvious.

If it is written to go against the Constitution then the bill would be created by leftists.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: SECTION 1. Tennessee Code Annotated, Section 7-51-1401, is amended by adding
the following language as a new subdivision:
"Adult cabaret performance" means a performance in a location other than an
adult cabaret that features topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators who provide entertainment that appeals to a prurient interest, or similar entertainers, regardless of whether or not performed for consideration; SECTION 2. Tennessee Code Annotated, Section 7-51-1407, is amended by adding
the following language as a new subsection: (c)
(1) It is an offense for a person to engage in an adult cabaret performance:
(A) On public property; or
(B) In a location where the adult cabaret performance could be viewed by a person who is not an adult.
(2) Notwithstanding § 7-51-1406, this subsection (c) expressly:
(A) Preempts an ordinance, regulation, restriction, or license that was lawfully adopted or issued by a political subdivision prior to the effective date of this act that is in conflict with this subsection (c); and

The Tennessee state government is trying to legislate how performers can dress while they are on public property. I don't think that will pass muster with the 1st Amendment. The law violates the performer's right to freedom of expression.

Luckily the Dems haven’t dismantled the Bill of Rights (yet), so that same 1A protects citizens from their actual rights being taken away by the government.

It's written too broadly ... and will be shot down in court.

... and cabaret does not typically feature nudity. A show of that type which does feature nudity, would be described as "burlesque."

If we are talking about a performance on public property, the onus is on parents/guardians to keep children away from where these shows are taking place. Those performers have as much right to be there as you do. As long as they are fully clothed, it should not matter to the government if they are cross-dressing or not. The government has no business regulating how people dress.
