Hunter Biden's lawyers have responded to allegations that they conspired to lie to a court clerk in the First Son's criminal case in Delaware by saying the incident was simply an 'unfortunate misunderstanding.'


Delaware Judge Maryellen Noreika had ordered the First Son's attorneys to explain themselves by 9pm Tuesday or be sanctioned.

Just before the deadline, Hunter's Latham & Watkins lawyer Matthew Salerno filed a response claiming the incident was down to 'an unfortunate and unintentional miscommunication.'

It was alleged that Hunter's lawyers sought to remove testimony from IRS whistleblowers about the Justice Department's lackluster criminal investigation into his tax offenses from the court docket.

'The matter under consideration appears to stem from an unfortunate and unintentional miscommunication between a staff member at our firm and employees of the Court. We have no idea how the misunderstanding occurred, but our understanding is there was no misrepresentation,' Salerno wrote to Judge Noreika on Tuesday evening.

He claimed that Jessica Bengels, the Latham staffer accused of pretending to be from another law firm, has a phone number which should show up as 'LATHAM' on the clerk's caller ID.

My staff and I have been communicating with federal judicial clerks for decades and I can tell you that I would absolutely fall out of my chair if this was anything other than a miscommunication or misunderstanding, as the Biden attorneys say. According to news reports the attorney's legal assistant or paralegal called and spoke to one clerk about the filing, to be handed off to another clerk. In that process, the clerk got the impression that the call came from the filer's legal team, which was incorrect. But it is easy to see how that would happen.

The reason I think it is so highly improbable that this assistant intentionally misled the clerk is that it makes no sense. Its not like the filing would disappear forever and no one would realize it. There would have to be an order on it, to strike it for example, which would itself be part of the docket and notice to everyone on the case. It just doesn't get removed without remark.

It literally makes no sense to make such a misrepresentation. None. There would be zero benefit and nothing but downside.

This is the right wing hysteria media jumping at the hint of scandal, without remotely understanding the way the process works.

I agree that it's most likely a miscommunication, I couldn't imagine a lawyer concocting such a scheme unless they were sure they had some serious top cover.

I see someone bought into the hysteria of misconduct. But it makes no sense that they would have done this because it would be immediately apparent.

There's no such thing. It doesn't go on the docket then magically come off. Its an electronic record.

I agree with you but if this went like "how the process" worked for a convicted felon with a gun charge and multiple willful failure to file/pay tax charges, Hunter would be going to jail...

If you understood how the federal docketing system works -- and you don't -- you'd realize how extremely unlikely it is that this was anything other than a misunderstanding by the clerk as to who the staffer worked for.

Its just more proof that there is not some sweetheart deal in place by the left wing overlords.
