The Hunter Biden Thread

I’m going to pose this question again. How can a team of high priced, high caliber and competent attorneys go into a hearing with a pre arranged and pre agreed to plea deal that in fact wasn’t anything near what they thought it to be? How can they have this notion that their client would be immune from any further future charges when in fact the prosecution team says completely otherwise?
Could it be that both sides already know how they want this to play out and how it’s going play out and this is scripted for appearance sake? I can’t believe the fact that the Biden attorneys didn’t know the limits of their own plea agreement, how completely incompetent could one possibly be? The legal team for the President Of The United States son are complete dumbasses? Come on! Anybody got any other theories here?

Seems the real problem was that the lawyers were all on the same team, and the judge wasn't a member. She asked the one question that they didn't want asked, and the collusion between the two "opposing" teams collapsed.
 
Yea I guess worded poorly. I was saying nothing that could ever come from the current investigation.

I guess plea deals fall thru often. Does it matter at all if a defendant walks in ready to plead guilty, with an agreement in place, and then ultimately pleads not guilty?

That seems to point out the duplicity in our legal system. The guilty will agree to being guilty if he's not punished or if he's let off with pleading to a lesser crime. Apparently it's not really about justice and proving the actual crime as much as the whole thing is a show to get a conviction for something.

And your point is the icing on the cake. He was going to plead guilty to charges that now he says he isn't guilty of because the penalty conditions aren't as favorable. Sure looks like a person willing to commit perjury for the right outcome. The really slick part in the whole thing was the immunity part, and it sure looks more like the two sides were colluding as a political favor than it was a simple misunderstanding.
 

LMAO .... Dumb Democrats are in full panic mode now. Having their weaponized DOJ go out to arrest the star witness for the prosecution. Wow ... no rules or laws apply to dems. What have these morons have to hide in protecting Joe & Hunter when they have committed crimes against the USA? Lol ... if a Republican had done such a thing you'd think our democracy had died in darkness.
 
Based on what has reported so far, Hunter Biden got a deal that is typically not given to similarly situated taxpayers.

This will be tl/dr so I will try to break it up

Just to clear a couple things up

1. I have been of the opinion that the IRS needed more funding for basic support operations, technological infrastructure, and attacking the most egregious violators/schemes. If things are more efficient, you will see far fewer errors on returns. Part of attacking the worst of the worst is taking away their freedom when it is proven they willfully evaded tax.

2. You will see people who say "most people who have issues with the IRS don't go to jail so Hunter doesn't deserve to go." That is true but disingenuous. The IRS deems 99.9% of all underpayment notices, etc as an error in omission, judgment, circumstance, or ignorance of law. The 99.9% does not or should not go to jail, it's the.1% we are talking about here. The fact pattern that has been reported clearly shows we are in that .1% range.

What the IRS really needs is simplified tax code. Then it's easier not to make mistakes; of course, then it's also harder to justify/hide stuff that politicians put in the tax code to protect and repay their sleazier side of the electorate.
 
A source close to Archer confirmed reports that he is set to testify about meetings he attended with his and Hunter's foreign business partners, where the First Son allegedly had Joe Biden on speakerphone. DailyMail.com reported exclusively this week that Archer is 'in hiding' after receiving 'threats' leading up to his bombshell testimony.

A spokesperson for the House Oversight Committee told DailyMail.com that the they are 'interested' in hearing from Archer about 'whether foreign actors targeted the Bidens and if President Biden was involved in his family's business dealings.'

The Department of Justice sent a letter to a judge Saturday urging an expedited sentencing for Archer - for an unrelated fraud conviction - in a last-minute attempt to stave off his testimony. Republicans say the move by DOJ is an attempt to 'intimidate' Archer, who they view as being central to providing information that is critical to their ongoing investigation into the Biden family's business dealings.

It is unclear the motivation behind Archer's decision to testify on Monday. He previously cancelled on the committee at least three times in recent weeks.

I’ll defer to him on tax law and the facts of this case and just point out again that lawyers don’t tend to tell their clients to plead not guilty when they’ve got a sweetheart deal and prosecutors wouldn’t be telling the judge that the investigation remains open with additional charges possibly forthcoming if the fix had been put in form on high. Also the fact that the judge was clearly there to put them through their paces is another indication that the institution is at least going to try to get it right.

Sure looks like the judge wasn't in on the deal making ... almost like they misjudged her and she was a bit sharper than the DOJ and defense lawyers had counted on.

This article and a couple others that I have read say that the prosecution hid the non prosecution agreement in the pre-trial diversion agreement and that judges don't typically weigh in on pre-trial diversion agreements. So if I'm reading this correctly HB was getting a non-prosecution agreement.

Exactly. This all reads like Hunter gets a slap on the wrist and walks away a free man with a "Get Out and Stay Out of Jail Free" card in his hand. The big deal was in exchange for a small slap in the wrist he would get a blanket immunity from his other sins ... until the judge caught on.
 
The parts I'm guessing that are causing the controversy. That paragraph 15 immediately below includes everything in Exhibit 1. Only upon questioning by the judge did each side reveal their belief as to what was included in the plea agreement. (prosecution of FARA violations)

Some of that sounds remarkably like what the intelligence community considered behavior inappropriate for granting a security clearance. Addiction and other abnormal/unacceptable behaviors invite seduction and then the means to bribe a person to divulge intelligence ... or in this case favored political treatment. Joe should absolutely be dragged into this because he had the ability/means to make Hunter's deals work out. By letting this happen Joe is a willing accomplice ... he's not just the unfortunate father trying to protect a wayward child; he is complicit.

No risk of #DevonArcher arrested before his Monday Congressional hearing. Government filed a request with the court to set a self-surrender date, which Archer objects to pending his appeal. Issue will get litigated by the court, but not before Monday. Likely DOJ retaliation.
