As to whether it was illegal or not, I don't believe it was. And I think a non-biased Judge and DA would agree. Hell, the SCOTUS and the DOJ already agreed to that.

What path would he take us down?

Well, if we can clear up the wwiii mess without making too many missteps, I'd look at entitlement reform and trimming the military. Probably lots of regulations need to be touched and refined for being overly restrictive or not accomplishing their purpose.
