Thanks for the short version. I’ll read the longer ones as well. That’s interesting about not playing a big role on appeal but I figured someone on here had better insight on it than me so I asked. The 4/4/4 thing got too much press as that related to the underlying crime, not the charges being considered by the jury. Do you agree or is that part of your concerns with jury instructions?The quoted is a lot to read, but I think the Tl;dr version is that people on both sides of the media focused on the “another crime” thing WAAAAAAAY more than it deserved given New York appellate law and I don’t think it will play a big role on appeal.
From the little I followed this case, my focus on appeal would be the judge’s rulings during Stormy Daniels’s testimony and the places where he deviated from the pattern jury instructions.
Yeah so I posted the pattern jury instruction a few weeks ago and while I do think his instruction seems consistent with the case law, any time the judge deviates from the approved instruction I would attack that on appeal. Jury instructions are critical to the assumption that creates all of the hurdles you face on appeal. So if the judge deviates from the norm on those, I’d pursue it.Thanks for the short version.
