Trump on track for Supreme Court Victory on Census Citizenship Question

Reagan tried a similar thing and Saturday Night Live did a skit. Been a long time but the joke was, after asking if the respondent was a citizen, there was a follow up question, "If someone were looking for you, where would you hide?"

Point is, the entire Court saw through the charade of reasons offered by the Trump administration given the mass of evidence that the real reasoning was to discriminate. So sure, it gets sent back, and the department can try to make its internal reasoning match what it publicly claims. But the other side will be entitled to discovery, to take depositions, to quiz the decision makers on the real reasons for it. And then that goes back to the lower courts. It does not go back to the Supreme Court.

The process would take several years, at least.

The Court has called the Trump administration a liar on this subject. No way the administration goes back only to be embarrassed again.

Its over.
Yeah, I hadn't thought about that... I doubt it would "take years" but it will take longer than April 1st.

I promise you that the discovery process alone -- not to mention litigation of the issue to prepare a record to go up on appeal again -- would last past the next election.

Is this the SDNY case decided by Jesse Furman? If so, put a fork in the citizenship question. It's over for the purposes of this census. He already skewered the administration for lying. The new evidence just makes it worse
 
Chief Justice John Roberts really tore Commerce Secretary Wilbur Ross a new one in his opinion... he pretty much called him a liar. Will Ross keep his job in light of this? Well, of course he will!

Just sucks how many justices R Presidents have put on the court and they turn out to be leftists, never happens the other way around. Dem Presidents do a much better job putting justices on the courts who will remain loyal to the agenda

It just sucks (for conservatives in this particular case) that your point person (Wilbur Ross) couldn't come up with any better reasoning than that the question was needed on the census to better enforce the Voting Rights Act. Roberts used the word "contrived".... that was being kind.

How about some accountability from Ross here? He really screwed this up.

That is not consistent with what you have already said in this thread. You have compared him to Ruth Bader Ginsburg and said that he was a leftist. It seems you care a lot for what he has written but you are wrong. He clearly wants a balanced and centrist court... and that is not a bad thing for our country at all.
 
Trump just tweeted that he wants to delay the census. He does not comprehend that this will get much worse for him, not better.

That’s why RBGs replacement needs to be a solid pick, if that happens. Amazing how the screeching has stopped from the left with some very centrist to left leaning rulings from SCOTUS picks that were supposed to be the scourge of the earth.

My guess is that Trump trying to delay the census may not work out.


The census is mandated under Article One, Section Two of the U.S. Constitution, which directs that a census take place every ten years. A delay via executive action would be unprecedented and likely considered unconstitutional. This is Trump pouting and when he is at his worst.

SCOTUS decision is garbage IMO as I think citizenship is a perfectly reasonable question to have an accurate breakdown of all the census “categories”. But the ruling has been made, so I’m not sure that’s the hill I die on if I’m the Trump admin.

Practically speaking, it just doesn't work that way because the illegal aliens will choose not to respond to the census with that question on there... and that is precisely what the Trump administration wants. Roberts threw the BS flag on Ross for his "protecting the Voting Rights Act" nonsense. As I mentioned earlier, however, this is not a critical matter because illegal aliens tend to live in places which are already heavily populated. The vast majority of illegals live in these 6 states:

1) California (#1 most populated)
2) Texas (#2 most populated)
3) New York (#3 most populated)
4) Florida (#4 most populated)
5) Arizona (#14 most populated)
6) New Mexico (#37 most populated)

They either go where the jobs are or they stay close to their port of entry. Even without including illegal aliens, the dispersion of federal funding would not be significantly impacted; neither would the allotment of seats in the House of Representative where California, Texas, New York and Florida are already 1, 2, 3 and 4 in terms of number of seats. Trump has not proven why this is such a "very critical matter" - in his words.
