That's something that fits luther to a "tee."
If it’s a binary choice between somewhat limiting congress’s power and not limiting their power at all then I think (Absent hindsight from the argument) it’s harder to find five votes for limiting.
Structuring the arguments to give a media foil makes it too nuanced for consumers of drive by media to digest. Same concept as Barr’s 4 page summary becoming the narrative and Mueller’s 400+ page report getting sent to the shredder.
Without Juxtaposition between Sekulow’s and DOJ, the headline is “SCOTUS ignores precedent. Sides with Trump.” Now, headlines are “SCOTUS looks poised to reject Trump argument.” Second headline is much more appealing to the Chief, who they expected to be the swing vote.
