No doubt. What I've heard is don't even take the FST. I'm no lawyer, but I'm pretty sure you aren't legally required to get out of your car unless you're under arrest. A FST is a way for an officer to determine if you should be arrested. The lawyer I talked to said the best thing to do is write your information down on a piece of paper, have it in your car, and if you get pulled over driving drunk just hand the officer your information. Say nothing, do nothing, agree to nothing.

Yep do that and see how far you get. When you take the test for your drivers license you sign a piece of paper that says if you are stopped and suspected of DUI, you will submit to a test to determine whether or not you are DUI. Enter the Violation of the Implied Consent Law. By refusing, you will automatically lose your license for a year, regardless of whether or not you are convicted of the DUI.
Now in Tennessee, if you are drunk and have an accident, you can still refuse the test, but it will be taken anyway. That was added to the law last year

Yes, you would probably lose your license for a year, but with a good lawyer, I think a very good case could be made using the 5th amendment.
Also, as a college student, I know I would much rather lose my car for a year than have a DUI haunt me on every future job application.
in most states refusing to take the test is admission of guilt. though you can ask to have them take a blood test which gives you the time it takes to get back to the station to sober up.
From experience here in TN it is not an admission of guilt but bylaw if you refuse you lose your license. When I messed up years ago my lawyer asked did I take a test. I aid yes. he said never ever take a test. you can't prosecute what you can't prove.
Damon's "companion" in the car (Courtney Fuhrmann, pretty hot) was arrested also for disorderly conduct. Maybe she told the police to back off her man.
