UT under potential NCAA investigation for NIL

Yeah. NCAA screwed up here. Let’s see how quickly this goes away now. A public apology needs to be issued. You’ve got the university, collective, and now the state aligned against you.
Best case scenario is this. NCAA realizes this won’t end well for them, backs off, and establishes some clear, well worded rules for NIL. Quick and nobody gets dragged through the mud. We will see though.

TN governor
TN Attorney General
Tom Mars
Donde Plowman and Danny White (who just spent 2 years learning the ncaa methods)

I'll take our starting 5 vs the ncaa right now
Would’ve took Mars alone versus them. I’m not even worried about this being a win in the end if it goes to court. It’s the damage to the program while this drags out that concerns me. May not be much but it would be better for all parties for this to go away.

Of course the ncaa could see that this is their last stand and chose to push it.

The NCAA isn't smart enough to do that. They desperately want to stay relevant within the power conferences and will die on this hill to do so.

You're assuming the NCAA isn't full of arrogant Farvas that can't handle having their (waning) authority challenged.

I think it’s a last stand scenario and they chose to target us because we were already on probation and increased scrutiny so they can try to sway some opinion towards their argument based on that fact alone.

They’ve bitten off more than they can chew, in my opinion.

It won't drag out because we are on the offensive and are forcing their hand. This goes against a USSC ruling and multiple states laws. They picked a fight and are about to get jumped

I completely agree with you. There’s no possible way they win. Idk that the NCAA has ever resolved anything quickly though. I do expect more of a pile on though.

Yep. I could totally see this being the hill that they are actually willing to die on. If they back off and effectively conceded that they have no legal authority to regulate NIL deals for prospective athletes, then they really, truly have no reason for existence anymore.

I mean, the case for their existence has been bad and getting worse for about 40 years now, but even in their own eyes they wouldn't have a reason to exist any longer if a court says they can't regulate NIL.

I agree when it's on their timeline. However I think we're going to force it given the people behind UTs case. Can't drag your feet in federal court

Carson is being paid well but not by the collective. He's going to be doing legit endorsement deals. I don't know if he'll be a Doctor Pepper guy or not but he, like Stetson Bennett and Brock Bowers. will make a lot of money based on their true NIL.
Correct me if I’m wrong but I think Nico’s doing a “legit endorsement deal” - I think with ForceFactor - Walmart - here’s a video

The only winners here are the attorneys and their billable hours.

I recall seeing McAfee? or some young Turk talking about being at a bigwig media meeting and hearing rumors that "something big is coming with the NCAA" and "they're getting the NFL to the table" and that "don't be surprised to see something happen and give it chance before you just dismiss it."

Maybe the NCAA didn't get the answers they wanted in discussions and they've picked a hill to die on. I don't know. Maybe they're trying to speed up the process of their demise and replacement. I don't know.

I do know that as lousy as the NCAA is, there's got to be an organization that can deal with the interstate commerce issues of college athletics.

Without the NCAA, some of the SEC and B1G and a few others are going to have to create "faux NCAA" or "NCAA+" or something or we'll see each state legislature start screwing with trying to "legislate rules to govern college sports." We're already seeing those incompetent weasels stick their noses in this. When was the last time the government helped untangle a mess?

I don't see a good endgame for anyone here.

I think they are trying to use this to get Congress to move on legislation that will benefit them. They know after SCOTUS they are in no man’s land.

That's what I'm not following. How does Spyre, which the NCAA mandates cannot be connected to any school, having an NCAA issue get UT a bowl ban?

If my neighbor commits fraud, I am not in trouble.

Spyre <> UT. UT can't get punished directly with sanctions or bans based on what Spyre did.

I get that UT isn't just a passive bystander here and has a close relationship with Spyre, but I don't see why they are in this UNLESS these folks are right in saying the NCAA is trying to change the definition of collectives to boosters.

That attempt makes zero sense to me, if true, because boosters have always been forbidden to do EVERYTHING collectives were designed to do.
Spyre is a private business that the ncaa and the university have no control over, the new lawsuit the AG of Tenn tweeted out with the state of Virginia also onboard and probably more states joining will effectively make the ncaa be in court for several years and so far those court rulings have not gone in their favor historically. Tennessee is about to end the ncaa rule over college athletics NIL with this lawsuit, and the ncaa governing body may not survive this

I think the issue is the NCAA's system has empowered a small number of schools in a small number of regions. It has reduced the fairness and parity of the sport.

The NCAA's rules favored the SEC and specifically schools like Alabama over other SEC programs to the point that a lot of fans, schools, and even entire states are just turned off by the NCAA now. I think they are seeing the blowback.

Popular opinion also tends to indicate the athletes should be paid. When you only have 4-5 teams competing for National Titles over the last decade, it is a problem for the sport and shows the NCAA is NOT working, especially when rivals of these opponents get investigated and these programs aren't touched.

(Tennessee isn't alone in the Alabama situation, LSU has been investigated a lot. Auburn has came up. Ole Miss was investigated once they started beating Alabama, etc.).

Again, when has Congress fixed anything? Seriously?

The United States Congress has nothing better to do than set a workable plan for college athletics? They could barely elect a Speaker of their own House of Representatives, haven't passed a real fiscally sound budget for the country in years, and on a good day don't contribute to the demise of the Republic...... and they have very few good days.

Short of the kids in a day care playroom, there is probably no other group of individuals I'd rather not have a voice in this than Congress.

I never like to buy a product unless it's been endorsed by a 19-year-old college sophomore who hasn't played.

Sure, people can pretend to pay attention to products endorsed by Hall of Famers like Peyton Manning and Tom Brady. Psshaw.
I prefer the recommendations of student-athletes of little accomplishment who are fulfilling a term in their college bribery contracts.

College sports has just got stupid---like much of America. I mean, college football players endorsing products is no different from
young nobodies on YouTube--ordinary people we call "influencers"--telling other young nobodies what products to buy. It's
the Kardashian effect...."I have no real talent--but I have an attractive face and an enormous butt, so please watch my reality
TV show and help make me rich." Young Americans: "We will Kim! We will!"

SNL could do a funny skit on all this if they showed a goofy college band tuba player endorsing some crazy product as part of his NIL deal
or payment contract.

We can be sure that a lot of the players who are getting good NIL/bribery money now will not become NFL players. But on days, they will be able to look back fondly on their college years and say, "Well, it's too bad I wasn't good enough for pro football--but I did make a lot of money off
those rich old saps at Texas A&M for doing nothing. And that was fun."

When's the last time Congress voted on a funding bill that lasted longer than 3 months...you know, the bill that guarantees they get paid...???

Reminds me of an old Andy Rooney, 60 minutes, story from back in the 80s about Congress (government) taking over the Mustang Ranch brothel in Nevada. Within 2 years it was bankrupt...how does one go broke running a legal prostitution house???
