You are correct. But not in the way you think you are - let’s all ruminate on the fact that in 2016 the president elect lost the popular vote by 3 million votes. In 2020 the president elect won the popular vote by 7 million votes. The electoral college margin was the same in both instances. The electoral college was created, in part, because our government determined that 18th century rural voters lacked the resources to make an informed decision as to who should be president. I can’t imagine trying to justify that as an argument in the 21st century.

Why not argue something substantive like this as opposed to embracing precipitous self-delusion?

I interpreted that as “we should hear it but we are not going to grant the relief requested” granted I’m not that great at dissecting lawyer speak and never care to be.

I realize the motion is dismissed and never questioned that. I don’t remember seeing a statement that was a dissenting opinion (even though it reads like one) and somebody even said it was 9-0. If it was 7-2 as you say and those to dissented then that makes a lot more sense

No. Thomas and Alito dissented on hearing the case. They felt SCOTUS should hear it. But they made clear they too would deny based on merits. So 9-0 is Ok to say basically. There are copies of the written result in Presendenti

Would love to discuss the “moderate” comment. In order to moderate, wouldn’t policy or at least ideology need to exist on a compatible continuum? What areas of policy even remain between the two parties that can be watered down into moderation? Infrastructure? Even that seems dead on the floor every time it comes up for vote

No... it’s 7-2. Thomas and Alito said they should hear it the rest said they shouldn’t. That’s it. There is no 9-0 people are taking liberties with that. When it was first announced and I read it that’s what I thought but then of course in the victory lap here they stated a bunch of misleading crap.
