Judge: So councilor, you are conceding that there is indeed SOME harm involved with leaving a student in the dark regarding their NIL possibilities, its simply a question of how MUCH? I see.

D'OH!
The NCAA 5 degrees of harm to student athletes
1) not any ( signed with Alabama)
2) hardly any ( signed with Georgia)
3) little bit ( signed with Ohio State)
4) quite a bit (signed with (Florida State)
5) a whole lot ( signed with Tennessee))

This is not exactly what we should be hoping for. This puts a lot of pressure on justices who have to prove their fairness in the face of external pressures like this.

This isn’t external pressure. Releasing a hit piece against a school to get legal and political support against them with details only an investigator would know is external pressure.

Stupid questions but.....

Will the federal judge rule that Tennessee, who is a member of the NCAA, doesn't have to follow the bylaws of the organization they are a member of? Would Tennessee have to withdraw from the NCAA and if so, who would govern Tennessee, themselves?

Interesting that Price is covering the hearing. Dont know how much experience he has in courtrooms. Will be interested to see if news reporters that generally cover trials are there from the KNS or other outlets.
It's probably his first time in a federal courthouse since they took us Comm students to tour the Knoxville courthouse in 2006! Good times.

This seems like it’s going to drag on for months if not the next year or so. Both sides are steadfast and it doesn’t sound like it’s going to be a quick process. It does sound like UT has a great chance to win though. Fingers crossed. Sounds like we can sell that we will fight for the rights of the student athlete at least. Maybe that will help stave off the negative recruiting pitches.

Should hear from injunction soon. Overall suit will be a while imo; ncaa is fighting for its life.

Explain. If you are in violation of home of association bylaws, the home owners association can enforce rules.

If any member of any organization's bylaws are in violation of the rules, isn't there a penalty?
In this example is the organization’s bylaws (werent even written at the time) in violation of the supreme courts ruling?

So exactly what is the NCAA claiming Tennessee has violated? Old bylaws that are deemed unconstitutional, or at least viewed by Tennessee as unconstitutional? Did the Supreme Court state that the bylaws are in violation of the law?

The question is selective enforcement and the NCAA violating their own rules (leak) and guidance, as well as the lack of legal basis for the rules that the organization has brought to bear (antitrust rulings in the past).

NCAA had no laws governing NIL at the time of Nico’s recruitment. They had some guidelines that were very confusing. They’re trying to redefine spyre as a collective to be a booster where they can use old laws applying them to NIL. Their interpretation and attempted enforcement of this violates the Supreme Court decision or at least better legal minds than mine believe so (even the judge from today). I don’t think the court had an opinion on the bylaws but they certainly will have one on how they’re used if it violates a kid getting information about their fair value.

Flying a giant UT flag IS 100% "outside pressure". A general good idea is to not make judges feel intimidated in any way. They very well may rule in a manner which assures everyone watching that they didn't unduly favor UT bc of such pressure.

If the judge is “intimidated” by that he’s in the wrong profession. I really think the judge is more worried about making the right decision by law than worrying about who thinks who was favored.

As much as I love big orange flags, this probably wasn't the best idea honestly. I am certain it is a show of solidarity and not any attempt at intimidation (because this would be the weakest and most unintimidating tactic ever).

It is slightly, slightly maybe viewed as poor taste and unnecessary. May even be wise to take it down.

The more appropriate time to display the flag is after the judges ruling. Either as a celebratory win, or show of support if goes the other way.....

Maybe he is in the wrong profession. But, I sure don't want him finding out on my case.

At the end of the day the NCAA is going to lose if this goes the distance. The rules about NIL they have in place now we’re not there when Nico was recruited. Everything was very vague then and are still vague. Even the NCAA president himself is on record during the time Nico signed complaining the had no rules or direction on NIL. The NCAA is toast if they go the distance. GBO
