Our position is that the factual findings of the Committee on Infractions should be set
aside on the following grounds: (1) that the factual findings are clearly contrary to the
information presented to the panel; (2) the factual findings of the panel do not constitute a
violation of the NCAA Constitution and Bylaws; (3) there were procedural errors and but for the
errors, the panel would not have made the findings or conclusion. Additionally, the Panel abused
its discretion when it imposed upon Tyndall the maximum show-cause penalty and 50% percent
suspension during his first year of employment at the University of Tennessee.
