Ainge DUI

I haven't been following this thread closely. If one were to assume that Ainge had a blood test drawn, I can tell you from work in the legal field that those results can be delayed for months by the back log in the TBI system. In fact, some of those tests are delayed so long that charges are ultimately dropped.

My questions were stemmed from a personal friend who was arrested yesterday morning in Tennessee.

I'm not a police hater but every time I have this conversation about citizen's rights in a DUI pullover and engagement, some policeman calls me one. :dry:

You don't have to admit that part of the police's job is to hang as many DUIs as you can, the statistics on pullovers and DUI charges speak for themselves. It's what po-po do. It's part of the work order.

Fine. Police have many other important things to accomplish that I value including hanging a DUI on someone who deserves it.

Nonetheless, whether a murderer, a rapist, a penny thief or a drunk behind a wheel, everyone of them equally deserves to know their rights and to demand them. To not be bullied or psychologically manhandled into making all the wrong choices.

The last time I was in or around General Sessions court, the blood tests were backlogged an extraordinarily long time.

I doubt that is something that has been fixed in the past few months.

Sorry I based my assumption based on the posts you had made. We both know what happens when assumptions are made. Citizen rights are important and I agree it seems you here of cases everyday where a right is taken from someone. Thankfully this country is not a police state like Europe where I can stop you because I want to. with the progressive camera systems in most patrol unit these days if your stop was not justified you can usually get that past a jury. I can honestly say the video system in my car has saved my bacon (everyone enjoy the pig reference) multiple times and never once hurt my case and ultimately will hang you or save you. Though I am not a libertarian or constitutionalist I do believe in the constitution and all it stands for. We both have two polor opposite ideals for how DUI stops should operate and I respect that even if I think it's wrong. My belief comes from the fact it's not a right to travel the highways or public funded roads it's a privilege and when you sign for your driver license you agree to obide by the laws of Tennessee. With all in mind I'd before than happy to argue it over beers just have someone else drive... Lol

I would hope that as a public servant that sworn an oath to uphold and defend the Constitution, you would be a constitutionalist. As far as the right to free travel, I would refer you to Sheriff Richard Mack. A very good read for us all.

Let me say I appreciate your attitude and insight. I disagree about the public funded roads portion. If any amount of the taxes I've paid go into the road system it is by that very fact my right to drive on them. The state has the right to test my ability to operate a vehicle safely, and they have done so and charged me to do that as well. Again, I appreciate your candor and ability to reason. Just don't give me "the party line". You seem like an intelligent man. :hi:

I wish there wasn't so much polarization when arguments like this come up. I know we all make assumptions but for the record I also don't trust police when it comes to DUIs/drugs. I DO trust them on most other things and don't hate police at all. A close relative is an officer and a fine one at that and I've met numerous outstanding officers, including a KPD officer who was incredibly kind and helpful and I owe more than words can express to one LEO (my personal hero). Unfortunately, there's also a lot wrong with how police operate in our area as well as throughout the country and that leads to a lot of distrust. There's also a ton of corrupt little towns around here that only hire people to run their cons or overlook them (and that's at every position in their town from sewer workers all the way to police officers).

Because there's so much power in carrying a badge and a gun, law enforcement has a tendency to draw from a pool of those who are either truly heroic or bullies by nature. We need more heroes and we need our sheriffs and chiefs to set policies that better screen out the bullies. RICO and seizure laws also provide too much incentive for those departments and towns that are corrupt or are in dire financial straits and we need stronger rules there regarding what and who qualifies.

We have to find a way to balance abuses of the system with catching the true bad guys and doesn't incentivize corruption. That goes for politics, governments and the police.
