Right, he didn't follow policy and because of that he isn't employed any longer.And arrested him with absolutely zero evidence. Here's some more:

Based on the DA's designating it a deadly weapon no, you should not be charged. If someone points, and further more discharges a lethal weapon at you you are afforded the right to defend yourself. The direction they are moving is of no consequence, or at least it shouldn't be.If you or I shot a guy and killed him for pointing what we knew to be a taser at us while he was running away, would/should we be charged with anything?
This may have already been asked but I saw on the news where they had him move his own car. I know this has nothing to do with the topic at hand. But isn’t that really strange if they thought he was drunk?
So question since we have been discussing police standards here is a hypothetical:
Let’s say Brooks knew if he got arrested for DUI he would be violating his parole and be sent back to the pen. Knowing that and in his drunken state he tells himself he’s not going back and is going to do whatever it takes to not go back. He sees the cuffs flips out and decides he isn’t going back. Dude runs, wrestled the cops, takes one of the cops tasers and turns to hit the cop with the taser with the intent to kill cause that is his only way out.
What do you do as the cop?
I'm mildly surprised. I actually was hoping that police around the country would get their unions and FOP in front of this and push for changes on their own... as a sign that they are willing to change with the times. But instead, they are choosing to have a temper tantrum and only offer 2 choices, maintain status quo or we quit. I haven't heard of any major movement to look for middle ground... and there is plenty of middle ground available to cops.
True, but the media and politicians can’t have middle ground. What else will they have as a platform if we are al getting along? Can’t have that at all!Looks like now the pendulum is swinging too far in the opposite direction, now.
Looks like it is time for reason and pragmatism. We can't have full blown authoritarian and untouchable cops nor can you have anarchy. Seems like there is room for a middle ground, but the cops are choosing to either quit or maintain the status quo.
So a little drunk is ok if he slams into and kills a family of 4 right? You know, because he was only a "little drunk"If I'm being honest with myself, I would probably do what this cop did. That doesn't mean I couldn't, or even shouldn't, have handled it differently.
Let me ask this, when does the police officer's safety matter more than the citizen's they are there to protect and serve? While it can certainly be argued that a taser in that situation can be lethal, it is without argument that the police officer's pistol absolutely is lethal.
Let me be clear...this by no means excuses what Brook's did. He is absolutely culpable. While the shooting may be legally justified, there is debate as to whether it should be legally justified in this case. This guy wasn't out raping and killing and causing mayhem. He was a little drunk, but cordial and polite with the officers all the way up until the cuffs came out, and then made a really dumb and stupid mistake. He paid for that mistake with his life. I don't think that mistake is worth a life.
It can happen. I’ve been falsely arrested once. I didn’t resist and I made my case to the judge, not to the cop because I knew nothing would come of that. I was also grabbed and thrown on the hood of a police car for no reason at all. They thought I was someone else. I was respectful, we talked through it, and that was that. Mistakes do happen and how people choose to react goes a long way towards the outcome.
