Colin Kaepernick sits during national anthem

GF is a outbound director for Target distribution and she was called a racist today by some clown because she called him out for not doing his job. He asked to speak to her boss and her about it and flat out said he felt he was being discriminated against. Her boss and her then had a discussion and felt that it's a battle they didn't want to fight. It's something that has hurt my GF deeply and anyone who has ever known her knows what kind of person she is. She has to now deal with being insulted with this racist term while this guy gets to go back to doing his job half-assed without any fear of repercussion.

Here is my take

He has been in the league for 6 years. For those 6 years, he had no trouble standing for the Anthem.

Now, hes fighting for a position on the team and likely a roster spot

I really think he got some bad advise from someone and started this as a reason to hold on to his position, instead of earning it. He thought he would make this absurd statement, hoping it would force the hand of the management. If they did release him, it wasnt because he sucked but because he spoke out against preceived racism, in turn, making management look bad

The timing is just too good to be anything but a ploy to force a decision, not based on merit, but how the public sees A victim against the oppressor, in this case, the Niners

I think it was a ploy to get attention, but I can't say if I believe if anyone helped him cook up this idea. I think he did this on his own.

Tell her to document everything she can that relates to him not meeting set performance expectations. He doesn't get a pass because he's black anymore than a woman gets a pass because she's female. Your girlfriend might not ever use the documentation, but at least she can feel proactive in the situation instead of feeling walked over.

She would need to do that to all her subordinates, not just him. Or he just uses it against her.

Unfortunately when something like this happens to me I try to think of all the evil **** I could do as retribution..... After I run out of good ideas I feel much better

I don't see how people possess the tact to work anywhere with an HR department.

I'm ignorant because I don't feel oppressed by my country or white people.

The deal is we will always be divided if there's constant strife stirred up between us. The peer pressure on you has to be hard. If you don't toe the line you're called all sorts of names.

People need to ask themselves, who does this racial tension benefit? Does it benefit the common working man, black or white, who is trying to earn a living for his family? Absolutely not.

How is he going to use documentation of his performance against her?

The documentation would have to be of all employees otherwise that's targeting. That would be my guess. Probably in their employee handbook. At least it is at my company. Having said that the employee in this instance would have been told to pound sand where I work. I have dealt with many "racism" charges against my managers. We take them very seriously but they are rarely justified. Once the facts are laid out the employee usually sees how they screwed up. The goal should be center every conversation around what the employee did and how it impacted the organization and their coworkers negatively. Investigate to make sure other employees who comit the same offense are held accountable to the same standard and move on.

Why not just document moderate to severe instances of poor performances for every employee you see?

Documented behavior of all employees is what you would do.

Writing up poor performance for one employee only, an employee that has already thrown accusations at you, would be laughable at best and more likely a disaster.

1, I'm an HR manager. 2, I didn't say anything about "measuring" performance. 3, I would assume she already has a system to document performance of her employees and she needs to be diligent when she documents his. It isn't rocket science.
