No and yes kind of.

It appears the chain of custody receipt was lost during that period of time. Now the server could have been sitting in that very same place for that amount of time, but there's no way of proving that since, again, there is no chain of custody.

In a court case, such evidence would likely be thrown out on the grounds that no proof exists it wasn't tampered with.

To expand further, Hillary's Dell PowerEdge 2900 that the FBI lost chain of custody for was used from Mar 2009 through Jun 30, 2013; almost the entirety of her tenure as Secretary of State.

Losing the paper trail is pretty much the same as losing the object.

To any lawyer or investigator that is.

Understood and agree on the legal implications. I just wanted to make sure I understood. The document isn’t saying they didn’t know where it was during that time (or isn’t stating that outright anyway) just that they cannot prove it’s location or who may have accessed it during that time interval.
