Federal Indictment of Donald Trump

It's absolutely nothing like taking the fifth. I do question why anyone would hire you to represent them.


If, as you say, he has nothing to hide, why didn't Trump return the documents as he was asked for them repeatedly over the last year? Why is he trying to stall the investigation? Why did he take the 5th so many times in that case in New York?

why did the DOJ object to a Special Master being named - I mean if they have nothing to hide they should welcome the transparency amirite?

Because the review was already done and the attorney client privileged material already separated out.
 
What was funny to a lot of the legal guys was that by asking for a special master, you admit that the documents are real in the first place.

That was until this Cannon judge came along. It's not funny anymore. It means that the evidence that was legally obtained and collected for a criminal case is no longer available to the LAW. It means he has temporarily taken it out of their hands, and who knows who's hands they will wind in with trumpettes beholden to him in hidden corners. There is a good chance this judge just committed obstruction.

I’m pretty sure it’s illegal for them to determine what is considered attorney/client privilege. I heard/read about the statute recently. That’s why it is important to have a neutral 3rd party step in now.

I don't know why he didn't. Maybe he believed they were his personal papers and belonged to him, is it unfathomable to you that people would disagree with a decision a .gov department made?
How is Trump trying to "stall the investigation"?
He took the 5th because he followed his attorneys advice, how would you advise a client in a similar situation?
As to the special master, if the DOJ is solid in their case why would they object to an independent party reviewing the documents? If the DOJ is correct isn't it reasonable to believe that an outside neutral party would substantiate the DOJs claims? In my mind it would even bolster their case.

No, it is standard to have a separate group of attorneys do that screening.

Trump is yet again playing a procedural game to try to run out the clock and once again evade consequence. Who knows, may work yet again. But I guarantee you that whatever the result of the review Trump will appeal and ask for the stay to be left in place.

The motion for a special master is a delay tactic in THIS case. I guarantee you he appeals the outcome, no matter what.

You need to have an actual reason to challenge it. Trump's are made up, but the judge gave him the benefit of the doubt. You can debate whether that was a favor to Trump or designed to keep him from having that argument down the line. I lean to the former but have an open mind.

I think after all of the FBI lies and obfuscation discovered during the PutinGate investigation Trump has ample reason to challenge anything coming from the FBI/DOJ.

Let me ask you this from a criminal's viewpoint. I'm the former President of the United States, I'm leaving office and I direct Mayflower Moving and Storage Inc. to pack up any and everything with a "secret" folder and send it to Mar-a-Lago along with the drapes and lamps. A year and a half goes by and I haven't hidden, copied or done anything with the secret documents if I have no ill intent. On. the other hand if I was looking to sell them to Russian and China I would have copied and scanned them before the FBI raided my house.

By that logic every criminal defendant or suspect can demand court intervention to stop the investigation "just in case" something seized shouldn't have been. Think about that for a bit.
