Federal Indictment of Donald Trump

The Executive lacks the power to simply ignore the law. Congress passes laws which the Executive is obliged to follow. So, you could not be more wrong.

In regards to classification and deciding on what records are that of the Executive, Congress has no authority to restrict the Executive.

What is your basis for that opinion? Congress has already done just that. He may keep personal records, but records relating to the official duties of the presidency must be turned over. Stop buying into that nonsense.

And how did the Court rule in the Clinton sock drawer case? That is the basis of my opinion. The Executive decides what is and isn't an Executive record. Seeing how the Biden DoJ is once again weaponizing itself, I now understand why Courts have given the Executive such unlimited authority.

Once the President leaves office they do. That is part of what the Presidential Records Act does.

Once the President leaves Office with his records, they are his to do with as he/she pleases. They were entrusted by voters with nuclear codes and the Nation's highest secrets for 4 years. They are provided SCIF's to store the documents afterwards.

His personal records, yes ... but according to the Presidential Records Act of 1978, the President must hand over all Presidential Records to NARA upon leaving office. The Presidential Records Act has been linked here many times. You should take 30 seconds and read it. It is very specific on this matter.

they won't read it. It will not reconcile with their wants and feelz.

Instead, they'll climb into whatever echo chamber tells them what they want to hear.

They'll be completely stunned when the partisan pundits predictions and opinions on the legality of Donny's shenanigans don't play out in court. It will be an outrage for them.

Here it is again .... probably the 10th time it's been posted.

Presidential Records Act (PRA) of 1978

The 7th bullet point down reads as follows :

  • Establishes that Presidential records automatically transfer into the legal custody of the Archivist as soon as the President leaves office.

Yes, but can't he just wish that part of the act away and pretend it doesn't exist?

And the Court has answered your bullet...this responsibility is left SOLELY to the President.

Judge Amy Berman Jackson agreed: “Since the President is completely entrusted with the management and even the disposal of Presidential records during his time in office,” she held, “it would be difficult for this Court to conclude that Congress intended that he would have less authority to do what he pleases with what he considers to be his personal records.”

Judge Jackson added that “the PRA contains no provision obligating or even permitting the Archivist to assume control over records that the President ‘categorized’ and ‘filed separately’ as personal records. At the conclusion of the President’s term, the Archivist only ‘assumes responsibility for the Presidential records.’ . . . PRA does not confer any mandatory or even discretionary authority on the Archivist to classify records. Under the statute, this responsibility is left solely to the President.”

The Court has already ruled on this, as shown above. You are wrong, as usual.

Wonder how long it will take the professional victim to let everyone know that the US Marshalls and courthouse staff were openly weeping while he was being processed?

Anybody want to touch an over/under of 12 hours?
Tears of laughter or joy?

The law says what it says ... I understand why you would prefer to focus on that, but it was not a Supreme Court case.

Bahahahahahaha. You understand why I focus on the Court case and not your improper reading of law?? "It was not a Supreme Court case"?? Bahahahahahahahaha...now you are just throwing the gun at me in desperation.

Some of you are so pathetic.

Funny how those worried about their political enemies being above the law are in no way worried about the law being applied differently to their political enemies.

How do you misinterpret this :

You are an idiot.
