Those analogies fail at every level. Horribly.
The prison: First, they undertook to prevent his escape. That they failed does not render them liable for every bad act he commits. If it were otherwise, jails and prisons would be liable every time such occurred and the law does not recognize a duty to the public on the whole for this. (Trust me, this is my area of practice for 25 years, I know whereof I speak). Second, the fundamental difference is that the homeowner left a loaded gun in an open garage ALREADY KNOWING there was a risk posed.
Defense lawyers and prosecutors: They have absolute immunity for acting in such capacities. Again, if it were otherwise the system would not work.
You should’ve been disbarred a long time ago just for what you post here.
