Go read the last page. She suspended her own ruling until the Supreme Court rules on it. In other words, it is a total political statement that she knows is unenforceable and will be overturned. More political theatre to keep stupid people entertained.

The Secretary of State shall prepare ballots for a presidential primary election. A ballot must include the name of a person who files a petition with the Secretary of State in accordance with section 442. The Secretary of State shall determine if a petition meets the requirements of sections 335, 336 and 442, subject to challenge and appeal under section 337.



The consent must contain a declaration of the candidate's place of residence and party designation and a statement that the candidate meets the qualifications of the office the candidate seeks, which the candidate must verify by oath or affirmation before a notary public or other person authorized by law to administer oaths or affirmations that the declaration is true.

Following a process that was determined by the residents of the state through their representatives in the legislature and codified and published in their laws so as to give notice and create transparency is how this decision should be handled.

Look at the clip I just posted, even the CNN anaylist says there was no due process, she is appointed by the State legislature not democratically elected by voters, not up to the states to interfere federal elections and procedures she used to make this obvious biased corrupt decsion were not up to "snuff". These cases attempting to interfere with a federal election are being thrown out left and right by State Supreme Courts except for corrupt leftist court in CO.

The closest thing we have to a federal election is the election of senators, outside of that there is no such thing as a federal election.

Who elected the legislators that passed the laws and appointed her? How have you lived here long enough to be so old that you care about cable news and twitter shills but don’t understand how a republic operates?

He probably didn’t get due process, it’s not a court proceeding. He can sue for a writ of mandamus or injunction and get judicial review of the decision where he’ll have notice and an opportunity to present his case to a neutral judge.

And FWIW, it looks like the hearing was conducted with due process. Trump was given notice of the issue and governing law, he was allowed to appear through representatives, and he made argument to the official empowered by the state to make the determination.
On Monday, December 11, 2023, I issued a Notice of Hearing to all parties, indicating that a consolidated hearing would be held at10:00 am on December 15, 2023, in Augusta. The Notice informed the parties that the hearing would be conducted in accordance with 21-A M.R.S. § 337 and the Maine Administrative Procedure Act ("APA").

Could argue whether 4 days was sufficient and whether the adjudicator was unbiased but the latter has become such a constant refrain that it’s hard to take seriously without compelling evidence.

You are clearly going to provide this quality of shrieking hysteria about made up ******** every time this result is reached, no matter what process is used to reach it.

Still think a single national interpretation of “engaged in insurrection” is necessary. Application of that standard should address the totality of what happened with the fake electors through January 6, not just January 6.

Beyond that, a state legislature using legislation, signed by the head of the state’s executive branch, to empower some state official to determine presidential qualifications by a legislatively approved procedure, which determination and procedure is then subject to judicial review to ensure constitutionality seems like a nearly ideal operation of a constitutional republic.
 
He checks the boxes. The qualifications for office of the President:

1) Natural born citizen
2) At least 35 years old
3) Resident of the U.S. for 14 years.

If there is a national standard it should be simple, a conviction in a federal court. But I don’t think we need a national standard.

That is more of a process than interpretation of the meaning, than what I had in mind but requiring a conviction seems like the best way to prevent abuse.
