I'd always been given to understand that a "tush hog" jumps straight to violence even when it's not warranted. I said that I've been accused of having that "attitude" not that that's what actually happens

I actually don't fight since I learned early on that one of two things is going to happen 1) I'm going to get hurt and I don't really like pain all that much LOL or 2) I'm going to cause someone else to be hurt and I'm a pretty crappy sadist

You just don't need the distraction right now, not now, of all times. Best to suspend him for the game, put it aside, prepare for the game, and then address it next week or even later.
Undoubtedly what will happen. His experience will be missed a lot but he's playing in front of better athletes.

Someone enters your house uninvited, you have no idea what their intentions are. They’re drunk and irrational. You try to get them out and they start to get verbally abusive possibly resist leaving. At what point do you defend your home there? Pretend now you got some DA on the internet saying you should lose your job, your opportunity for defending your home.

Just let us know what your thinking. Make sure you stock the fridge with some food and beer if we decide to make ourselves at home in your home.

While they're actually IN my home? Or threatening to burn it down from outside, maybe?

Walking away and being mouthy? Not so much.... let 'em mouth off all they want. I'm just glad they're leaving....

I don't mind hurting people who deserve to be hurt. But I'm definitely no sadist, there is no enjoyment in it.

My "aggression" has always been more "productive" and measured. I'm not pure fight or flight. There's a time and need for both... you don't seem to recognize or accept that.

Thanks for hoping on my behalf. As for me, I don't much care either way.

Because if I'm in a situation that would truly benefit from a weapon being brandished, the last thing I'm worrying about at that point is the paperwork that is going to need to get done after the fact.

There are places were brandishing is considered aggravated assault with a threat of serious bodily harm and will get your caboose thrown into jail, so it’s a wee bit more serious than just some after the fact paperwork based on where one lives.

Know your areas firearm and weapons laws folks!

Again: if I'm in a situation where brandishing a weapon is the best option, what comes after is not at that point a significant concern.

Stay alive, protect your family and unit; work out the details later.

You get that, right?
 
1) If the other residents support whatever story McCollough has, then charges will be dropped.

2) If the other residents support the complainant's story then McCollough is in trouble.

Which do you think is more likely?

That is contract law; a person with dementia and anyone under 18 can't buy a car either.

So you're saying if a girl is drunk and gets raped, the police won't take her statement? You're saying I can go out and rob drunk people outside bars and police won't take their report?

Hmmm..... seems a reasonable assumption to make regarding a person who obviously feels the need to be insulting during what has been, for the most part, a relatively rational discussion regarding how one would react to someone accidentally walking through your front door.

Oh, and please do swing by my house and invite yourself in. 1) the gate is locked, 2) the door is locked, and perhaps most importantly 3) if you choose to ignore both 1 AND 2 I am most definitely armed and willing to use.

I like to think I learned my lesson regarding strangers "just walking in" when it happened the first time.

And, yeah, I'm just the teensiest bit proud that I managed to learn that lesson without beating the ever-lovin' snot out of someone (no matter how deservedly) and ending up putting my freedom and financial future at risk.

Again why are you relying on the statement of the drunk guy? You’re wanting to pass judgment on the actions of a kid without waiting to hear his side of it. This drunk guy already looks fairly suspect if either of us are being honest. Could it have been handled better? Maybe hell neither of us know but you’re applying rational behavior in an irrational time.

If someone comes into you’re house and they’re drunk and confused and talking crazy are you not very very on edge? You don’t have time to think about the right thing to do. Again maybe McCullough could’ve done something better but in this day and age I do not blame him for his actions. If I stumble into another persons house drunk, I fully expect I could get my ass whipped, I expect that possibility to increase if I open my mouth and say something stupid.
 
It’s a felony charge. Not just a “run the stairs” offense by any means.
