There is no federal regulation barring teh discrimination against smokers, in some states they might have protections but I doubt it's many these days.

People drug test for worker comp and they get a discount for it. It's not required.

I have never heard of anyone testing for cigarettes and it sounds illegal and just asking for a lawsuit.

Life insurance has smoker and non-smoker rates.

I haven’t toked ganja in years but don’t mind if it is decriminalized. Incarceration over possession of weed is silly.

That’s fine but people still don’t realize there still will be repercussions. Companies can still drug test and not hire you or drug test and fire you. You still can’t consume in public. You will still be prosecuted for operating a vehicle under the influence.

So, what's the issue?

The only thing that has somewhat recently started affecting smokers is health insurance and that’s pretty much based on an honor system. Also some places prohibit smoking ANYWHERE on company property.

Life insurance is not the debate here.

That is a completely different animal than property and casualty insurance or HR laws.

I can debate the insurance side all day.

The HR part is better left to a HR specialist.

I don't believe you are correct, employers can legally discriminate against tobacco users so they will be able to discriminate against drug users.
This is true. In colorado an employer can terminate if employee uses weed in personal time.

or, that's how it used to be a few years ago.

Your tangling legal issues here.

Hiring is not the same as property.

Non smoking laws exist everywhere.

These two issues arent the same.

Funny this is coming up. We bought a farm last year and I was told by a neighbor early this year that the people that sold it to us were "hippies". About two weeks ago I noticed one of our goats eating a plant and he was foaming at the mouth a little. Sure enough it was marijuana.

Last week I was walking the property line and found a couple more plants in full bud. I've been sleeping much better the past week.

People consume vape cartridges in public and 90%+ have no idea they are getting high.

Just like alcohol you can get trouble for operating a motor vehicle.

But employers still don’t have to hire you and it’s still illegal for public consumption and operating a vehicle.
True. Employers can legally discriminate against marijuana users just like they can smokers. You'll still be required to take drug tests for employment and for insurance purposes.

People that smoke weed rarely just smoke weed. If I had to choose I’d take the war on drugs versus freely allowing habitual drug use.

In HS and college my buddies and I smoked weed A LOT while drinking beers or whiskey. Most potheads keep it green and only green for the most part. The doctors and medical professionals that throw patients opioids like candy are far more dangerous to society than bud smokers and the fourth meal they crave at 3am. The opioid epidemic in this country is a serious problem.

Our carrier requires it because many of our employees operate heavy machinery and then of course our drivers must be tested because of DOT rules.

A company does not have to hire anyone that refuses to take a drug test or someone that fails one. There may be companies that don’t do it but legalizing weed won’t stop the ones that want to.

Agreed and they should be if driving under the influence. No different than driving a vehicle drunk.

Your class code specific but not all carriers would.

I have been around both coke heads and pot heads.

The pot head will just eat all your food. The coke head will kill you for 5 bucks to get high.

I can't be pro cocaine or meth.

I have literally had teenagers die who worked for me due to it.
Youve never seen what someone who is a "pothead" does when they are also mentally ill...or if it's been laced with another drug

Maybe not but I also don't want to pay the rates a carrier that doesn't require testing would charge. I'm not going to subsidize someones drug use.

I’m not trying to compare weed to anything or use any whataboutisms. The “all it does is make you eat” , “drive slower”, or “alcohol is worse” have been stated millions of times. I don’t care if it’s legalized just stating people that think that means there will be no consequences for doing it will be surprised.
