McCollough indicted

Political pressure from the "me too" crowd made her pursue AJ, even though there was virtually no chance of a conviction.

Which is why I said "Stupid Knoxville Prosecutors". The Law is The Law. Political Correctness has NO PLACE in The Law. It's BECAUSE of weak people like this "she" that The Rule of Law in this Country is 100% GONE! But don't worry Counselor...I'm sure you'll get by...

The details, as revealed to me, showed that AJ is a scumbag, but that's not illegal. He definitely bears most of the responsibility for the situation and probably got better than he deserved.

One man's "scumbag" is just another man's admired cocksman, along the lines of Warren Beatty or according to your screenname..."Arnie Becker"

As Einstein said: "The difference between stupidity and genius is that genius has its limits."

You should read a little more about Albert, Counselor...he had his way with a few Co-eds himself in his later years...wonder if you feel HE "got better than he deserved"?

So you would go to McCullough 's apartment to confront him because your dumb son (in this scenerio) stumbled into the wrong apartment more than once? What would your defense be in that scenario? And if you want to be a protective father in this scenario, I think there are better ways.
There was no scenario presented. No. I would smack my son upside his head for getting drunk and running his mouth.

I'm calm. This is my opinion. At the end of the day, we have a guy that couldn't control his mouth and a guy that couldn't control his temper. Hopefully, both men will learn from this incident. I hope Jaylen doesn't get convicted of a felony. He did wrong, but he was provoked. Maybe that will mitigate things somewhat. I just don't see this as a slam-dunk nothing burger as some think.

Nicely done šŸ‘šŸ¼

Iā€™m just not buying Spencerā€™s story. If he was drunk enough to walk back to the wrong building after getting ā€œthingsā€ from his car then his credibility is lacking IMO.
He gets on the stand and paints it as if he merely opened the door and put his foot on the threshold and then leftā€¦. Like a good boy. Iā€™m not buying it.
Testimonies tell different tales in Jaylen McColloughā€™s assault case

This is the first time Iā€™ve actually looked into the details and it appears to me that Spencer was hammered. Iā€™m standing by my initial assumption that he got throttled and then stumbled to the stairs and fellā€¦. And it had to be a slow type of fall for that much blood to get on the stairs.
He was so intoxicated he went to a building on the other side of the complex according to document in the link.

I see it as an unusual prosecution.
If McCullough hit Spencer outside his apartment, it is still his residence.
Two feet outside the apartment, yes, that would be in the curtilage. At thirty feet, probably not.
I passed the VolNation Bar. Here is my understanding.

As a DB, McCullough has 5 yards or 15feet from the door to hit him and maintain contact.

After 5 yards, McCullough is obligated to let him run free.

I am not one of the members advocating shooting anyone they conclude is a threat on their property (I personally find many Stand Your Ground cases to have zero merit.), but McCullough has a reasonable expectation of safety from where his vehicle is parked (if he has one) to his apartment (if parking is attached to his building, which is normally the case), including the stairwell.

It's possible McCullough is in the wrong. I don't think we've seen statements that give a good indication he acted outside his rights, but there is always the factor of things we don't know happened.

I am working from the portions of the police report that were shared in this thread. I also noticed the police report portions that were posted were very neutral and did not indicate a slant toward or against either party involved. That report is supposed to be neutral, but too often they aren't.

Stand Your Ground laws are some of the most misunderstood laws because people don't take time to read them for themselves. As you know, it's not a license to use deadly force just because someone is on your property. There has to be a credible threat. Jaylen said that Spencer touched no one, threatened no one, and he wasn't intimidated by him. That's Jaylen's testimony. It could come back to bite him IMHO.

What AJ did had nothing to do with being a "cocksman". It's how he created the situation with his co-defendant. The Einstein comment has nothing to do with Einstein's romantic encounters. It merely speaks to stupidity, which AJ showed a lot of in this incident. Defend him if you want. I don't care. Just sharing some info I got from a highly reliable source. BTW, "LA" stands for Lower Alabama.

Having read the report, were I on the grand jury? I would have to hand down the indictment. But if this moron was standing there holding a bottle of Vodka? If Jaylen did something stupid? Well, he was not the only one. If it comes out that the guy with the bottle raised it in any threatening manner? If I were on the trial jury, I would acquit.

If he had raised the bottle in a threatening manner, don't you think that would have been disclosed by now? Again, Jaylen said the guy did not threaten anyone.
