When you start putting qualifiers on what type of judicial approach someone should receive, you open the door to the case that rich people should be given lighter sentences, that frat boys will be boys, and that some people shouldn't receive the full protection of the law because they had it coming.

Something tells me that's not what you want.

You know what I want? A truly faur and just justice system. I dont care if you are rich, poor, black, white, make or female. It should be equal justice for all.

Again, this guy doesnt deserve the protection that our legal citizens do.

I feel sure that same defense would be afforded to you or me if we murdered a Mexican citizen, while in Mexico.
 
Whenever you feel like you can do it I suppose. I have no remorse for those that murder. Their trial and punishment should be swift. Good enough hypocrite?

We're actually on the same side here; I can't figure out where my comments about the carriage of justice turned into you calling me a hypocrite. You quoted the old laws, I quoted the old laws. Can't pick and choose, or at least we shouldn't.

Now as for the accused, I agree; a swift trial with a jury of his peers, an automatic appeal of found guilty (sorry, part of the legal code), and follow it up with death by firing squad the following day if found guilty.

I believe we should also have rules that penalize lawyers for delay tactics that stretch cases out for months and years, but that's just me.

It is the humane, civilized, American, and Christian thing to do. Lady Justice is meant to be blind, and at this stage of the game that includes blindness towards his citizenship status.

The moment his trial is over for the murder of the young lady, shift gears into criminal hearings on his immigration status. They are two separate issues worthy of appropriate carriage of Justice.

No, the suspect is neither a victim nor a citizen. I used Emmett Till as an example because unchecked emotion and discrimination robbed him of his rights to due process.

If the alleged murderer were an enemy combatant, I'd have a completely different take on the situation. This person is not in our country legally, is suspected of committing a capital offense, but courts have consistently held that any non enemy combatant on American soil is granted the same due process rights as citizens.

I honestly can't answer it, except to say that an appropriate carriage of justice should he be found guilty of murder would mean he spends the remainder of his life behind bars until he dies of natural causes or death penalty. Lobbing him back over the fence would just be an invitation to do it again.

The trial against an illegal alien accused of murdering 20-year-old University of Iowa student Mollie Tibbetts has been delayed to next year and relocated to an Iowa county with twice the Hispanic population compared to the region where the alleged murder occurred.

In August 2018, Cristhian Bahena Rivera, a 25-year-old illegal alien from Mexico, was charged with the murder of Mollie Tibbetts after police said he admitted to confronting and chasing down the young woman.

Following a nationwide search, Tibbetts’ body was found in a cornfield in Poweshiek County, Iowa. The illegal alien lived in a region of Iowa surrounded by sanctuary cities, Breitbart News reported. He worked on a dairy farm using a stolen ID and Social Security card after allegedly crossing the U.S.-Mexico border as a child.

Now, the trial against Bahena Rivera has been delayed for the fourth time, getting pushed back to January 2021 following a motion by the prosecution and defense last month. The motion stated concerns about jury selection in order to comply with social distancing measures.

Likewise, the trial has been moved for the second time. Originally, the defense successfully lobbied the court to move the trial out of Poweshiek County, Iowa — where the alleged murder occurred — by claiming the lack of Hispanic population in the area would not be fair to Bahena Rivera.

Back in December, a district court judge ordered the rescheduling of the Cristhian Rivera jury trial due to the pandemic.

Cristhian Rivera, the man accused of murdering Iowa student Mollie Tibbetts in Brooklyn, made his first court appearance in nearly a year as his trial is set to finally begin.

According to NBC affiliate KWQC, Cristhian Rivera faces a charge of first-degree murder in the death of Mollie Tibbetts and the case has seen delays due to the coronavirus pandemic.

He was in court Thursday for a pretrial conference that outlined his upcoming trial set for May 17 in Davenport

Jury selection is expected to take two days and opening statements are planned for May 19.
According to ABC affiliate KCAU, Rivera allegedly killed Tibbetts and dumped her body in a cornfield, which he later led authorities to find.

The trial was moved out of its original location due to widespread publicity.

Fairness issues are expected to be a concern in the trial for Cristhian Bahena Rivera, a Mexican national who had been working as a farmhand in the rural Poweshiek County area for several years when he allegedly stabbed Tibbetts to death while she was out jogging in July, 2018 and hid her body.

"You heard about today with the illegal alien coming in, very sadly, from Mexico and you saw what happened to that incredible, beautiful young woman," Trump said at a rally in Charleston, West Virginia. "Should’ve never happened. Illegally in our country. We’ve had a huge impact, but the laws are so bad. The immigration laws are such a disgrace, we’re getting them changed, but we have to get more Republicans. We have to get ’em."

A month later, her body was found buried under corn stalks after a man confessed to hiding her body and led them to the scene.

Jurors were told that a homeowner's surveillance video would show Bahena Rivera's black Chevy Malibu appearing to circle Tibbets while she was out running in her hometown of Brooklyn, Iowa on July 18, 2018.

Bahena Rivera, now 26, allegedly later told police that he drove past her and turned around to get a second look because he thought she was 'hot'.

Jurors were also told that Bahena Rivera admitted that he got out of his car and ran to catch up with her but became angry and fought with her after she threatened to call police.

Bahena Rivera said the next thing he remembered was driving his Malibu with her bloody body in the trunk, which he then carried over his shoulder and hid underneath stalks in a cornfield, the prosecutor said.

Jurors viewed the images of the 20-year-old University of Iowa student's body on Friday as Mexican farmworker Cristhian Bahena Rivera, 26, stands trial in Scott County, Iowa, for first degree murder.

The first image showed Tibbetts' body covered by cornstalks with only her running shoes sticking out and visible.

Photographs also showed her body after the stalks had been removed: Her legs were spread apart and she was wearing only socks and a sports bra.

Crime scene photos of a pair of black shorts, underwear and what appeared to be a headband, which were found farther into the cornfield, were also shown to the court.

The images were shown as Amy Johnson, a criminalist with the Iowa Division of Criminal Investigation who examined the scene, testified as a prosecution witness.

An autopsy found that Tibbetts had been stabbed seven to ten times in the chest, ribs, neck and skull.

Bahena Rivera, who has pleaded not guilty, led investigators in August 2018 to the cornfield where Tibbetts' body was discovered, former Iowa City police officer Pamela Romero testified on Thursday.

The man on trial for the 2018 murder of Mollie Tibbetts gave shocking testimony in an Iowa courtroom on Wednesday that two armed men wearing masks forced him to drive up the college student the night she went missing.

Cristhian Bahena Rivera answered questions through a translator from his defense attorney Jennifer Frese in Scott County District Court in Davenport, Iowa, about what happened the night of July 18, 2018, when the 20-year-old University of Iowa student disappeared.

Bahena Rivera testified that two masked men wielding a gun and a knife appeared in his living room after he finished taking a shower and ordered him into his car, a black Chevy Malibu.

He said one man got in behind him and the other next to him. He testified that he followed their orders to drive and then stop near a jogger, whom he now recognizes was Tibbetts.
