I'm sure nobody's ever found themselves in a wreck due to a hardy sneeze, or while changing their radio, or lighting their cigarette.

Face it. This reasoning you're using is retarded. If everyone went along with it, cars would drive us.


Sure they have caused distractions and accidents.

And if people were lighting up with the kind of prevalence we see with cell phone usage, or if listening to the radio required you to hold it to your head or at least in one hand as you thumb out a message, you'd have a point.

But the point would simply be that those other things should be reconsidered, as well. That we don;t act the way we should in other contexts is a pretty weak argument against a ban of cellphone usage that makes perfect sense.
 
Question for the law enforcement members: Is distracted driving covered under reckless driving? So, for example, if Person A is driving and their driving behavior suggests that they are distracted (veering into an adjacent lane, traveling significantly below the rate of traffic, etc.), can you issue a citation to the driver? What is the citation?

Its just the cause, I believe. So the ticket is for reckless or careless driving. I don't think there is in Florida a specific traffic statute for "distracted driving."

Of course a citation can and will be issued but we are given a broad spectrum to charge for various reaons

I guess I don't understand why we need a specific prohibition. It sounds like L/E can already issue a citation if the motorist's ability to operate a motor vehicle is compromised by anything (eating, talkin on the phone, changing radio stations, etc.).

Secondary violation, you cant pull them over for secondary
 
Can you pull someone over for driving a Lexus into a ditch while transporting a harlot...even if they aren't talking on a cell phone?
 
I always thought L/E would nail a driver for veering into the lane next to them for something. I didn't know what the citation would be though.

If a ticket is issued have to articulate distance traveled and how many times it occured
