The SCOTUS changed the mandate from a fine to a tax but Trump ended it by signing this law passed by Congress:

On December 22, 2017, President Donald Trump signed the Tax Cuts and Jobs Act of 2017, which eliminated the federal tax penalty for violating the individual mandate, starting in 2019. (In order to pass the Senate under reconciliation rules with only 50 votes, the requirement itself, at $0, is still in effect).

Not knowing the facts is always relevant. I can accept an opinion if you are educated on the facts. It's apparent that Roberts is not which is problematic

I may be wrong and I haven't listened to the audio, but he doesn't refer to "Republicans" as trying to repeal the whole thing, he refers to "Congress." Like it or not one party is not "Congress." I think he's probably aware of the history and what he's saying somewhat inarticulately is that Congress never passed a law that repealed the ACA, therefore (the majority of) Congress did not intend to repeal the ACA.

My avi is a hell of a lot cooler than your skulls or whatever they are. More innocuous too. McDad has a nice dog as his avi. Is that a problem with you? What could possibly bother you about a kitten? Seriously.

I'm not up on DAF so I looked it up:

DAF is an acronym for dope as f***, which is used to describe something that is really cool. It often appears in texts or online in chat rooms and on social media.

People commonly use DAF for describing items, such as kicks, headphones, glasses, cars, and houses. However, the acronym is sometimes used to refer to people who are just plain awesome. The term is commonly seen preceded with a hashtag (#) when used on Twitter and Facebook.

So it's a cats vs dogs thing. That's lame. Honestly I've never cared much about other people's avatars but now that I look at yours, I can honestly say, you're one of the last folks who should complain about someone else's. Why should I adjust mine 'cause you're a dog lover? For me I love all animals so I like McDad's

The House of Representatives is "Congress". As to the partisan nature of all of this, I already addressed that. He should know how these things work in Washington. "Congress" tried to repeal it. They weren't successful, but they tried...many, many times

"All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives."

Even so, is the fact that there was a failed attempt to repeal it grounds for the Supreme Court to overturn the law?

Answer: no. So why did Roberts even bring it up?

I think it was dumb of him to bring it up but I'm more concerned that it wasn't based on facts. That's more problematic to me

My understanding is Roberts was responding to the argument that Congress intended to repeal the entire ACA because they made a potentially unconstitutional change to one provision. The point he was getting at is "If they wanted to repeal the whole thing, why didn't they repeal it?"

He probably should have just said "why didn't they" instead of "why didn't they try", but I don't think he was insinuating there has never been an attempt by Republicans to repeal it.

If thats the case, the lawyer supporting overturning obamacare probably shouldn't have made that argument.

I have not studied the entire transcript but if this thought was introduced by a lawyer then yes, that's irrelevant and he shouldn't have gone down that road. It still doesn't change my initial post which stated that John Roberts' statement was not factual. That's what's most bothersome to me
