They do it all the time for lesser cases. If a judge knows the person personally, then it is the proper action to recluse themselves from the case. Leaves less doubt.

A point to be made is we have read the grand jury report. The attorney general still has the grand jury testimony since the investigation is ongoing. The report could be more of a synopsis.

As to the last part of your statement. If he saw this happen and did nothing at the time, why does that change whether or not they would turn their head and allow him to hang around the program.
