My point was that they are allowed to develop their own bylaws as long as they are in bounds of existing laws. While we're all happy Alston happened, if you look at the judicial system's overturning of NCAA rules, there arent many examples of this pre-Alston.One example: you said the NCAA can govern itself in any fashion it wants, which is not true. It’s a non-profit organization whose membership is primarily made up of state institutions. It’s also under heavy anti-trust scrutiny. Its governance is heavily subject to court oversight, not to mention common-law duties any organization is subject to, plus (likely) a lot of contractual obligations.
Look, I agree this situation isn’t good, mostly because I can’t see anything we do not taking a bunch of time. But we don’t need to pretend the AA is still a powerful organization that’s on strong legal footing to act boldly.

We used to do that back in the 80s..we would hop over the fence at the ramp and go in there and throw a football around...we usually got chased out by security guards after a few minutes, but they never caught any of us..
Thanks for the reminiscence..brought a tear to my eye, one of my partner in crime cousins that I used to do that with died this week and he was a huge Vol fan..he was only 51

The real legal question is whether their enforcement of their own bylaws violates any exisitng law in this particular case.

I am as well, and they can be sued for arbitrarily and capriciously enforcing their own bylaws and rules, in addition to more anti-trust issues violating the Sherman Act.
