That's clever, they're basing the reasonableness of the contract on his joining the nfl instead of an ncaa team to avoid ncaa saying they recruited him to Tennessee.

Strains credulity since they're called the volunteer club, but maybe it'll hold up.
Eh, maybe. You have to remember that:

They are a Sports Management company. Their name is Spyre, not "The Volunteer Club". "The Volunteer Club" is one marketing segment of Spyre designed to generate NIL money to a segment of their clients--the UT ROSTER.

IOW, UT players are represented by Spyre as well, not recruits. Thus, it makes complete sense for them to have a marketing segment devoted to UT PLAYERS (who are already on scholarship at UT).

Doesn't sound like the NCAA is taking issue with Spyre representing UT roster players in part through VC. It sounds like they are claiming that Spyre recruited Nico to UT via pay-for-play, and provided impermissible benefits in recruiting by proxy for UT. Spyre is claiming that they are a sports management company investing in a player, and have a right to do business to that effect.

Here's the "guideline" in question.


It sounds like the NCAA is trying to designate Spyre as a booster, and thus the private plane ride was an impermissible recruiting benefit provided by proxy by UT. The problems with that are that Spyre is a pre-existing athlete representation agency that is on record stating that they did not use the NIL contract as inducement to recruit to UT, and is on record via their legal counsel stating that the contract specifically states that it is not contingent on attending UT.

I wonder if Spyre jumps into the lawsuit waters on this one, as it seems the NCAA is claiming jurisdiction on how a sports management company can do business with their clients?
I think they have to because this is functionally an attack on their brand
 
Third Parties Defined as Boosters.

As a starting point, it is important to understand how a representative of athletics interests(booster) is defined by NCAA legislation. A booster is, in part, defined as an individual,independent agency, corporate entity (e.g., apparel or equipment manufacturer) or otherorganization who is known (or who should have been known) by a member of the institution’s executive or athletics administration to have participated in or to be a member of an agency or organization promoting the institution’s intercollegiate athletics program or to assist or to have assisted in providing benefits to enrolled student-athletes or their family members.

It appears that the overall mission of many, if not all, of the above-referenced third party entities is to promote and support a specific NCAA institution by making available NIL opportunities to prospective student-athletes (PSA) and student-athletes (SAs) of a particular institution, thereby triggering the definition of a booster.

With this in mind, NCAA rules related to the involvement of boosters in recruiting activities remain relevant to the Interim NIL Policy. Specifically, NCAA rules preclude boosters from engaging inrecruiting activities, including recruiting conversations, on behalf of a school. Further, NCAArecruiting rules preclude boosters from providing benefits to PSAs and preclude institutional staffmembers from being involved, directly or indirectly, with the provision of benefits to a PSA. Finally,it is important to note that existing NCAA prohibitions related to pay-for-play have not changed asa result of the Interim NIL Policy.

Here's the section of the guideline in question.

True enough that's vague to the point of dangerous. It's basically impossible to follow, and written in such a way that almost anything can be interpreted as enforceable.

Look at the underlines. That makes ANY NIL to a college athlete an enforceable action by a "booster". It basically gives the ability NCAA to wield a sword at their own digression and interpretation.

As to the bold (bolded in original), that's the nit they need to pick. Is Spyre's overall mission to promote UT? And I guess by extension, was Spyre's courtship of Nico promoting UT as the underlying motive? And was Spyre's courtship of Nico as a client in fact UT recruiting activities?

Spyre was a sports management agency before the NIL can of worms opened. Part of their clientele business is representing UT roster players. The contract with Nico specifically precludes the need to enroll in any one university.

Seems like a hard hill for the NCAA to climb, especially if UT lawyers up, and the media backlash continues.

Great article. The audacity of the NCAA is amazing. They got their asses handed to them by the SCOTUS with a statement that basically said their model is in breech of anti-trust laws, and they should be afraid to appear again. What do they do? Move the scope beyond member institutions and try to tell private corporations how they can do business.

It's awe-inspiring, really.
 
I thought that was obvious. AL and GA have the most talent outside of OSU. They are protected by the officials. We are all hoping the expanded playoff changes that. That doesn’t have to be accomplished this year alone.
It all changes this year! Totally unrealistic optimism that’s absolutely unfounded. However, until proven otherwise I believe this is the year that Tennessee becomes the chosen program. DW has already met with Sanky and let him know that we are taking the SEC in the big 3 mens sports. Sankey can enjoy the ride or get steamrolled. He doesn’t have to cheat for us to win. Just has to stay out of the way.

(The Memphis VFLs have already invited Sankey to be involved in a long term tour of the Body Farm. He can be an integral contributor in it…if you know what I mean. 😈)

Like em or hate him he unlocked something Richt never did and Richt had perennial talent. I think Kirby is to defense what Heupel is to offense. Many people here are unwilling to see excellence outside our program. Saban may have had all the tricks in the world, but he's the SOB that unlocked them. It wasn't the dudes before him at Bama. Plus he did it at LSU too. If Heupel is going to be like those guys we better unlock some of this bs we claim the other teams have.
uga wasn’t allowed to brazenly cheat without consequences before smart either.

It would not have happened if uga was in the SEC West.

He is one of the sabanites that seriously has to out-talent the other team.

You will see this year when Tennessee beats the dawgs in their house.

We’re building our talent level. I think this is the year that we’re close enough that being out talented won’t be enough.

If you don’t think our entire OL and WR rooms have that game date circled for the revenge from last time, then I don’t know what to tell you. JJ is coming back and is working with the WRs all Summer on how to control dawg dbs. 😈
 
I’m seeing Bama, Georgia, Florida fans defending us on boards all over the place. Crazy days.
That’s bc if we go down they will also

Your top 15-20 schools should defend us also bc they will go down if we do

Everyone is guilty if we are which honestly we aren’t guilty of anything truth be told
 
The biggest thing is they did this right before junior days where parents are going to have questions that likely won’t have a complete answer right now.
A lot of parents think like the kids these days and want their kid to bring 💵 so I wouldn’t be surprised if the parents are impressed with Tennessee’s handling of the situation.

Edit: Our problem in the past was that our admin was horse dookie and unstable. We look very stable currently and these students and parents will see that.
