If she claims them, and then I also claim them, what happens?

If she claims them and her return is processed first, then your return would likely be rejected if you try to e-file.

So then you could paper file your return. You would likely get a notice or correspondence audit once your return is processed that you can respond to accordingly. If the facts and circumstances support your claim then you will be allowed the benefit on your return and her return will be adjusted by the IRS.

It would be a hassle but it's probably worth it. You might point out to her that if she files a tax return claiming a dependent that she does not qualify to claim under the dependency tests then she is filing a fraudulent return and she'll have to pay up eventually. The IRS moves slow but they will get it right if you provide them with the information.

edited to add: If you "need" your refund asap, then you can e-file without the kids (assuming "with the kids" gets rejected) and then file an amended return on paper claiming the kids. This gets some of your refund on the front end and also gives you an opportunity to explain that they qualify as your dependents based on the facts and circumstances.

Or he can change his withholdings to not have the government steal as much of his money.

Btw, Roof, if u ever fall behind in child support, the government will take all your tax return or the amount u owe and supposedly give it to the kids/ex-wife. I know u have custody, now, just saying if u owe anything.

The IPhone 7...and I have the latest update. I’m using Google to navigate VN and VQ. I was having to log in every time I switched apps on safari.

I have to open Volnation every day on my iPad but not on my iPhone. I have multiple apps open and a few windows in Safari but always have to re-open Volnation on the iPad only. Weird.

Do they have internet yet? Will there be a "What other fanbases are saying" thread? Or would that require someone to actually go to West Virginia and ask?

When you do paper file, include a copy of your court documents with your tax return.

My point wasn't political. It was that when we say tone deaf things it gives other ammunition to support dumb stuff like white privilege. Perhaps if we all just accepted that our experiences are shaped by many things (race, wealth, mentors, geography, etc), maybe we would be quicker to offer grace and would sound a bit less tone deaf.
