Probably still illegal, but would take more than it's worth to fight it. That would be like their saying, "You have to pay for pest control and it has to be from this one provider." Or, "You have to buy a couch and it has to be from this furniture store." They can't mandate that you purchase internet or anything else, it doesn't work that way. Now it might be legal for them to put it in the agreement and not lease to you if you don't agree, but even that may violate some laws. That's beyond my expertise, but typically you can't sign away your constitutional rights, and landlords can't refuse to lease to you because you refuse to sign away those rights.

Again, probably not worth the attorney fees to investigate and/or fight it.
Idk what’s it’s like in South Carolina, but renters have basically zero rights in Arkansas. I had a bug problem at my last place and literally could not get my own guy out there. It was in the company’s system that calls from my address had to be redirected to my property mgmt for approval and they 86’d it. Lucky for me, those idiots lost the lease renewal I signed, scanned and emailed over 3 months previously, and so I wasn’t under a lease and was able to submit a 30 days notice and bounce.

It’s funny that “constitutional rights” get thrown around so much these days. Constitutional rights are against government action and to core rights such as freedom of speech, religion, assembly, press, etc. along with no deprivation of life, liberty, property without due process. So, we are talking about an agreement between 2 private parties.

It appears the FCC has outlawed exclusive rights deals bewteen cable providers and landlords. However, that was 14 years ago to strictly cable providers. Also, I would guess this isn’t exclusive because they are allowing tenants to pay for their own service (even if it’s on top of the fee for their service). The cable service can be an amenity just like a gym or pool they offer. It will be in the contract and part of the rent, so it’s important to read the entire contract.

That’s how I see it.

You can't force people to purchase something (exception Obama with Healthcare), that's a constitutional right. The constitution doesn't only protect against government.

And if you do somehow get around that and force them to buy something, you can't force them to buy it from somewhere specific. Where do you get the idea that the constitution only deals with government?

Housing is not just any regular agreement between private parties. There are a lot of HUD laws and regs that come into play that don't come into play with other business arrangements. And the HUD laws and regs often reference constitutional law (can't refuse to rent to someone because of race), so there is a "chance" that forcing someone to purchase something outside the rent would be illegal, and refusing to rent to someone because they don't agree to purchase a good or service from your friend down at ABC shop "could" be illegal under HUD laws and regs.

There’s a family friend that might take it pro Bono for me if he’s not busy. I’ll ask about it tomorrow.

The Constitution applies to government action. I suspect Volgee got that from his time in law school and practicing law, because that’s where I got it too. I also don’t remember anything in the Constitution about not forcing people to purchase something.

Discrimination in housing is illegal, but you do not have a constitutional right to TV. I didn’t read the OP, but pretty sure the apartment complex is not forcing anyone to buy anything because if you don’t want to buy their TV, you don’t have to live there.

Bingo.

The constitution guarantees freedoms. It prevents ANY party from infringing upon those freedoms, not just the government. The amendment abolishing slavery being the obvious example. That has nothing to do with government infringing in rights, its 100% about private parties infringing on the rights of other private parties. The commerce clause is one that could also come into play regarding private parties dealing with each other.

Sure - the 13th Amendment applies to everyone, including businesses, but I think we can agree enslavement is a little different than most things we’re talking about. Though there may be another provision or two, the 13th Amendment is the only thing I can think of that regulates how private business and individuals interact. All the commerce clause says is that Congress can regulate business in certain situations.

The rights outlined in the Bill of Rights that everyone thinks of as their Constitutional rights, applies to government. You can be fired for speech. You can be fired for association.

Augusta National, Boy Scouts, and Masterpiece Cakeshop (Masterpiece Cakeshop v. Colorado Civil Rights Commission) all say hello. All instances where private groups/companies were allowed to discriminate against other groups of people.

Although landlords can't discriminate against race, religion, etc., that law falls under the Fair Housing Act, which was legislation that was passed- not from the U.S. Constitution. Adding a cable fee as part of rent does not fall under that type of discrimination.

Nope...but it can amount to theft. It seems like a complex could do good business by advertising how they are not thieves like the rest...I assume they get away with it because the market is tight in those places and there is no true competition for renters..

I work with the Japanese quite a lot. They are good, kind people. However, just like most other Asian nations they are very set in their ways. They cannot think outside the box and are quite robotic in a lot of ways. Many times when the Japanese come here for a few years to work they hate having to go back to Japan. They literally cry sometimes.
Good thinking spelling out Japanese. If you shorten that word, people will throw a fit on here

Are there any preppers on here? Wife and I recently started canning food and storing up in case of more lockdowns/loss of job etc. What do you guys do to prepare food and water? Any tips?

Gray, Morris, To’o To’o, Lawrence, Middleton. Bennett was dismissed. Crouch would be a great LB 10 years ago. Deandre Johnson is average
I think any very average players are going to be sorely missed due to depth this year. Worried about 2nd and 3rd string

Like why come back with *more* dudes if you’re just gonna pull a gun. Fight them if you’re so tough and stop being a little b. Guns are for pus*ies.
recall going to club back in College. Little man was talking **** to anyone who would listen all night, we left early cause we got tired of listening to it. We knew something was up cause he was unreasonably confident.

As we left, he tried to start **** with my roomate and I. We just shook our heads...as we did that we saw him reach for his waist band, WOC he had a pistol. We both just said 'whoa whoa, no problem man.'

Very lucky, and glad he didnt shoot someone.

I can only assume dudes who carry guns everywhere or try to solve all their conflicts with guns have micro pee pees and their guns make them feel tough when in actuality they’re deeply insecure and scared of the big bad world around them.

These guys crack me up, man.

Can’t wait for this post to get booted from the thread.

What if you or somebody around you has their life threatened by a nut case with a gun? You’ll be looking for a knight in shining armor then

And you think Jim Bob carrying his gun to the grocery store is gonna be that knight do ya LOL

Around the same amount of people fall to their deaths every year in the US that are killed by guns. Do you carry around a parachute? Or a pillow to throw down on the ground if you see someone falling?
