It’s funny that “constitutional rights” get thrown around so much these days. Constitutional rights are against government action and to core rights such as freedom of speech, religion, assembly, press, etc. along with no deprivation of life, liberty, property without due process. So, we are talking about an agreement between 2 private parties.
It appears the FCC has outlawed exclusive rights deals bewteen cable providers and landlords. However, that was 14 years ago to strictly cable providers. Also, I would guess this isn’t exclusive because they are allowing tenants to pay for their own service (even if it’s on top of the fee for their service). The cable service can be an amenity just like a gym or pool they offer. It will be in the contract and part of the rent, so it’s important to read the entire contract.
