Not one shred of that was proven...NONE of it. Everything was speculative and opinion. NO abuse could be proven. What could be proven is the witch shot him in the back with a shotgun while he slept and even initially lied about the circumstances. And yet she got a slap on the wrist. To most people with common sense...THAT case was open and shut.
The reason the jury believed the testimony about alleged abuse was because many of the people who worked with him daily at that church testified to his controlling nature. They didn't come out and say it but they many of them (church members) believed that abuse was a real possibility given his nature. I am not saying this is right, personally I don't believe abuse should even be considered in a murder trial. Abuse is no green light to kill.
All I am pointing out is the very different circumstances here. The fact that the weapon was not a weapon of convenience, it was a weapon that was bought a few days before for the purpose of killing McNair, that kind of evidence is hard to overcome in a trial.
