Every American in the country could claim an addiction if they needed/wanted to. How is that a defense?

He will say he was so shitfaced that he couldn't willfully evade taxes.

The problem is this defense is harder to make for sophisticated taxpayers with financial means to hire experts.

It looks to me more like I was so shitfaced I willfully told my accountant to not file my taxes for two consecutive years. I mean I get that addiction can be an affirmative defense but let’s not act like he did one single bit of the accounting work on his taxes.

"I was shitfaced.. I didn't willfully beat my wife"

I don't recall hearing those excuses ever working.

* Use of accountant/tax lawyer
* Reminder letters from IRS of filing requirements
* Disregarding IRS warning letter
* Failure to voluntarily comply with records request
* Large income
*Education
* Background
* Business experience

I’m not doubting your explanations you clearly know what you’re talking about or you’re one helluva poker player. I was just offering my own hot take. I can’t believe that crack head has even opened up TurboTax in the last 20 years and I’d guess they don’t have a money laundering / influence peddling add on to give him the tools he needs to file without an accountant anyway 🤷‍♂️

I agree. It's going to be hard for him to make that argument since he literally checked the box for everything I listed.

A high school educated farmer who runs into addiction and tax issues would be viewed differently than a Yale educated, rich, global corporate board member (within addiction issue) who has access to CPAs and lawyers....

Can a new plea deal be constructed after the defendant has already pled?

Yes, a new plea can (and likely will) be constructed. I wouldn't be shocked if some sort of nominal confinement will be required to get a plea done now if they combine the gun/tax charges

The more I think I really hope Joe pardons hunter. Again I don’t think it will come to that because I believe the DOJ and the rest of the swamp will protect the crack head but I think I it would be a yuuuuge political win for the Rs
