I’ll defer to him on tax law and the facts of this case and just point out again that lawyers don’t tend to tell their clients to plead not guilty when they’ve got a sweetheart deal and prosecutors wouldn’t be telling the judge that the investigation remains open with additional charges possibly forthcoming if the fix had been put in form on high. My understanding is that the defense thought they had a sweet heart deal and the prosecution was not reading the deal the same way.
Or, said another way: the prosecution didn’t agree to what the defense wanted. They may ultimately decide that it is an acceptable deal, but it is marginal enough that he backed out of it and the prosecution wasn’t just rolling over and giving them everything they wanted, which was the narrative on here.
It happens, it just doesn’t usually make national news. I think it’s way more common for the defendant to get up there and change their mind. But I did once get appointed to a case where the prosecutor and defense lawyer got so acrimonious arguing over what they agreed to that the defense lawyer thought it was in the client’s best interest for her to withdraw.How often do the two sides go to court in your experience thinking they have a deal and then realize they disagree on what the language of the deal actually means?
