No, Biden and Trump don't deserve to "share a cell." An absurd, ludicrous statement. Trump deserves jail--probably--because facts. Convictions, indictments--and more to come. Biden...nothing. All the Biden blather is just that--conspiracy nonsense. FACT.

such leaking is clearly problematic if you believe in a fair justice system.
We don't know who leaked the tape. I disagree that it hurts Trump. It gives him a chance to spin it any way he wants for the next few months without having to take the stand.

We know who leaked it. Trump's lawyer nailed it... It was too taint the jury pool and he doesn't say the document he is showing isn't declassified..

They’re not charging him with espionage, they charged him with willful retention of defense documents, which is a criminal charge defined in 18 USC 793(e). 793 is within a set of statutes titled “The Espionage Act.”

Based on the indictment, it seems like the elements are:
1. Unauthorized possession
2. Documents related to the national defense
3. willful
4 retention or failure to deliver them to [NARA].

I think someone in the DOJ leaked the audio recording because they believe that Trump has destroyed the classified material concerning what a hypothetical invasion of Iran would involve - which Trump was describing in the recording.

I'm not saying it's right .... but it shouldn't bother you as much as what Trump did. He knowingly revealed classified information to people who did not have the clearance to see it. He even tells them that it was "classified" and that he can no longer declassify it. He goes as far as to tell these people that what he is telling them is "off the record," and "confidential." That's a consciousness of guilt. He is doing something that he knows he shouldn't be doing. He does this out of spite for one person - Mark Milley.

Things are bad when "It was bravado," is the only defense you've got. When has Trump ever given ground like that before? He knows he's in trouble here.

Judge ordered neither side taking about the case in the media. Hence the leak ...

Regardless of who leaked it ... Trump's legal team has a tough defense ahead of them.

That audio recording is shocking in so many ways. Trump even makes a joke about Hillary Clinton's e-mails being sent to Anthony Weiner. In doing so, he basically acknowledges his own past hypocrisy concerning the mishandling of classified material.

Agree. But the leak of it is not a minor issue, it's a blatant attempt at trying the case in the court of public opinion and tainting the jury pool. The DOJ shouldn't stoop to such levels.

He makes it clear that he realizes that he is describing the content of documents that have not been declassified, and that he should not be discussing them with the people of the room he is in. Even a woman in the room understands that what he is doing is wrong ... and she has been interviewed.

They were just speculating. It ultimately would have been released anyway as part of the criminal case, its not confidential or privileged in any way.

He makes it clear that he realizes that he is describing the content of documents that have not been declassified, and that he should not be discussing them with the people of the room he is in. Even a woman in the room understands that what he is doing is wrong ... and she has been interviewed.

You assume that Trump would view what was said as damning. He's in such an alternative universe mindset, constantly changing his story and revising his argument that I'm not sure he is capable of viewing it rationally.

It's one thing for something to be released in open court and something completely different when the DOJ leaks something months ahead of the trial.
 
I guarantee you that Smith is busting his tail to find out who leaked it. If it's one of his people, he's going to end their career. If it was Trump's team, that person should get legal counsel.

Meanwhile Trump's legal team lost a round in court again on trying to move the NY state case to federal court.

So you've got Smith on one side and the gang that can't shoot straight on the other.

Read an article in WSJ a couple of weeks back that talked about the trouble Trump has been experiencing while trying to get the top criminal defense lawyers because of his reputation for (a) not keeping his mouth shut, and (b) not paying his lawyers. They did say the head of his Florida legal team was a very well-respected and politically connected guy named Kise, but he says he's not doing the trial work and has been trying to find someone to take it, but can't because of (a) & (b) above. Story is that Trump had to pay Kise a $2 million nonrefundable retainer just for this part of it.

But everyone else on Team Trump is 2nd and 3rd tier. And they're going up against the alpha male.

So you right wingers need to help. Send those checks to Trump for his defense, please. Your kid doesn't need those new shoes, send Trump your check. It doesn't matter that he may now have broken campaign finance laws by using funds from his PAC for personal legal fees, send him your money. Tell your grandkids that you gave the money for their Christmas gifts to Trump. I'm sure they will approve.

LOL I didn't know you had such a good sense of humor.

BTW after your post about Smiths work at/with the Hauge I looked into his record, not very impressive. Basically, he has 1 high profile conviction that hasn't been overturned and his one case with the international court he left prior to it going to trial. I couldn't find any cases where he actually prosecuted someone in an international court.
