The (many) indictments of Donald Trump

What argument did I make?

It is you that is clearly interested in gamesmanship with Judge Cannon, and gleefully commenting on political ploys in her courtroom.

But you clearly are not at all interested in Judge Merchan and what is going on in his courtroom.

Why is that?
They are both playing games. I don't know why you did not understand that. It is the luck of the draw in judges. Time will tell on the performance of these Judges ability to manage their courts. Two different styles, two different levels of government, two different cases, two different jury pools, two different sets of lawyers, and two different locations. Maybe two different results, maybe the same. Comparing the two is like apples to oranges.
More ballgames cropping up in AZ and possibly in Michigan. Like I said before the Kitchen sink. It just creates more of a mess. It is political games, no doubt about it.
I don't agree with the NY trial, but the Democrats did it to save face.

I have read it and I know how it works. Broad interpretation of what actually happens.

LOL

The President has the authority to declassify anything outside of our nuclear secrets, he doesn't need anyone's approval nor can anyone override him. The only thing open to interpretation is who and how he needs to notify or record it.

This article represents the apogee of discussion on the matter of classification. Dispelling Myths: How Classification and Declassification Actually Work

from but one paragraph:

The only question then is: must the president follow any specific declassification procedures? The answer is a resounding no for two reasons. First, Executive Order 13526 on its face contains no such declassification procedures. The Order sets forth (1) who may declassify information and (2) what standards they should apply, but beyond that, there is no additional process required. While both individual agencies and the Information and Security Oversight Office have developed additional rules about how declassification should be carried out, none of these procedures apply to the president. Second, given the president’s constitutional authority over both classified information and the administration of presidential executive orders, even if Executive Order 13526 did establish constraints, they are at most self-constraints that the president has the power to ignore.

It is pretty much impossible to read this treatise by the CIA's office of the General Counsel and not conclude that the DOJ really has no case against Trump but Pence actually may have violated the EO and Biden as a Senator or VP almost certainly did.

Another interesting tidbit from the above link:

Another underappreciated fact is that information is classified, not documents. Documents are marked as classified depending on the information they contain. The classification marking on the document reflects the highest level of classification for the information contained in the document. But technically speaking, the document isn’t classified; it’s the information in the document that is classified. This distinction is important to understanding how derivative classification and declassification work, as explained further below.

You can laugh all you want but explain to me how an OPLAN would be of Public Interest? How HUMINT operations would be of Public Interest? Anything that compromises the Defense of the United States does not fall into the category of Public Interest. OBTW, you cannot walk out the door and say I declassified these documents on your way out, by thinking about them or without going through the proper process because some documents would greatly jeopardize forces, human lives and undoubtedly the security of the United States.

Again believe what you want to believe doesn't make any difference.

You stated I believe above that the President could not declassify Nuclear information well are you not contradicting yourself here.

There could be any number of reasons. But what does that have to do with the presidential power to declassify material?

I see you edited your post. Public interest is not a qualifier or limiter to the powers of the president when it comes to declassifying executive branch material.

In 20+ years of working for large companies and volunteering for several leadership roles within AICPA, I have NEVER seen anyone criminally prosecuted for including a reimbursement as non-employee comp on a 1099....
What do you make of the reported jury instructions?

JUST IN: The jury has requested to rehear instructions, after Judge Merchan denied them a copy of the instructions. They’ve now been deliberating for over 4 hours.

Trumps attorney Blanche, was once a prosecutor, looked at Trump and gave him a smile as the second note was handing to the judge from the jurors.

Trump’s team believes the longer it takes, the better it is for him because it means people are disagreeing with each other.

There is a process, Trump did not follow it. Based on unverified reports, he declassified that had to go through the process first. The magic wand thing does not work the way some of you believe. Most importantly based on unverified reports some those documents would never have been released and not made public for years. What's more, Trump would have never been allowed to take them home for display. I am sorry but that is the way it works, he declassified, process 6-8 months, remain in a storage vault and never released for Public. Declassified --- 6 months after the fact --- to go order no way --- public view maybe 20 to 30 years or never.
If he can't declassify nuclear related materials as you stated then why do you think he can declassify everything else, like OPLANs and GDPs? Why is it of Personal Interest? If he can declassify any document then why do you think them home with him?

What process? Find a link laying out the process for a president to declassify materials.

You have yet to link anything defining the process a president has to follow. Do you think I'm just going to take your word for it?

The process depends on the classified document, it is reviewed in detail to prevent any possible harm to those affected by the declassification. A complete analysis is done. It is not a declassify and go type event. Takes months. A declassified document may lay dormant for years and may not be removed from its area for years. Surely, you do think that it is a drive by to go order. I have no idea what Trump took, we may ever know, but if he took what was mentioned on the NJ tape (if true) a complete analysis would have to be done and it would never have left DC and more than likely the public would never know it existed. So there is a process, and a disposition of Classified Documents. Plans would have had to be rewritten before the declassification took effect. These documents are not just pieces of paper. A new designation of classification would also established. 99% sure the new classification would not be unclassified.

The fact that the Judge is unwilling to put his instructions on paper is as telling as anything that has been in this sham of a trial. He knows an appellate court is likely to chew him a new orifice but such is their desperation, he doesnt care.

The docs case was just the gangster thinking that he's above the law and could do anything he wanted as a president--an idea he actually expressed a few times during the four years he stunk up the White House with his corruption. He's claimed that he could just declassify documents himself, apparently just by thinking it. Wrong. He's a clown and a conman who wants to be an autocrat--wants to be America's Putin. Perhaps the gangster should move to Hungary and try to follow his hero, Viktor Orban. Or Russia. Why would he even take many boxes of documents when he doesn't even read?

Crap that goes on like this is not for public knowledge, public dissemination, or found on the internet. It is written in Standard Operation Procedures and regulatory guidance. The public gets what they need to know only. The details are in the pudding at the various agencies that are affected.

"there's a process" is hogwash.

If NARA has to approve the POTUS declassifying docs, then the POTUS works for NARA. But, that isn't the case, is it?

Besides, all Presidential docs are stored on a DOD server:

The Democrats don't believe in democracy. That's why they try to get Trump removed from the ballot and why they are tying him up in court.

BS

He does have declassifying authority, but must follow the process and some information may not be deemed declassifiable. Furthermore, if he does declassify it, it does not mean he can take it home. So quit twisting words to fit your narrative and desires. It may be declassified as to a need to know and when he leaves office he doesn't have a need to know.
Do you have a source I can view for that info??? Wasn't twisting, you just verified that unelected people have more authority over classified document then those elected... That's fine . Would like to read you source. According to the ABA (American Bar Association) seems to have a different opinion.
