I don't mean to suggest that he can keep the jury there 24-7-365. But it is in his discretion to keep saying "Go back there and keep deliberating." If the jurors are dug in enough they can wait him out, but I'm betting Merchan would not declare a mistrial until they've been going at least a calendar week.

Is this just a case by case, judge by judge, decision that you’ll see variability on?

I was wondering the same. On the radio going to work today I came across someone speaking to a journalist covering the case, and he was saying something similar about how the judge gives instructions to the jury is significant and made out like it could negatively/positively affect the prosecution or defense depending on what the judge said.
