Let me ask you a question, and I'm not trying to be snarky. If it would be logical for the owner to be concerned about vandalism in your mind, would it be a place that anyone would want to find themselves without permission of the owner?

With what we have read about the coverup, or incompetence, of the PD down there, you can bet that pretty much any and everything Arbery has ever done that is on record with them will be released to try and help the defense...and themselves. Although from a one of the first articles I read, it appears the police who were called to the scene were ok with arresting the McMichaels at that point but were told not to. I've read so many articles I can't remember where I saw that. The DA is the one that is going to be under a spotlight and rightly so.
There is a lot of info out there. And I'm sure a lot more, from both sides, will come out. Lots of money to be made doing articles and stories on this one.

Throughout this thread you've argued potential justification and/or mitigation for the McMichaels' actions up until the point that you can no longer do so, then you switch to arguing against the "media narrative." Then you start over on a different point, argue justification/mitigation, then fall back on "media narrative". Rinse and repeat. It's a really dishonest argument on your part.
I have plainly stated that i thought all parties involved made idiotic decisions, and that the crux of the case will land on the jury's decision of if it was detainment vs "aggravated assault". I am saying that the facts as presented from page 1 (which i knew wasn't the whole story then) isn't as clear cut a premeditated hate crime murder as some believe it is.

Legal proceedings require not the emotional outcry of people who have never tried an actual case except on Facebook, but honest inspection of both the laws, and the TOTAL circumstances surrounding the case to make the call.

When some of these posters first heard about Trayvon Martin or Mike Brown, they had similar posts and I tried to tell them then too, that the facts would likely produce a different outcome than "everyone" expected

Why won’t you answer the original question? Was the murder justified? Yes or no.

You literally did everything I just laid out over the course of one post.
 
I don’t believe it was murder. If they are found guilty it is likely manslaughter at best and getting off free and being sued at worst.

That’s not an answer but you already knew that. You’ve backed yourself into such a corner that instead of admitting you’re wrong, you plant your feet and dig in deeper.

No. Murder, in Georgia, is just "murder", and a key element is "malice aforethought". I don't think that will apply here.

Felony Murder is any death that occurs during or as the result of a felony (in this case, Aggravated Assault), and thus was the initial charge made here. Agg. Assault is not a lesser included offense to Felony Murder, hence the two separate charges.

If memory serves...I'll go check later...the only lesser included offense for Felony Murder (as it applies here) is Voluntary Manslaughter. Involuntary manslaughter is a lesser included offense for Agg. Assault. I could be wrong; it's been a while since I worked cases at that level.

We are a long ways away from opening arguments, and there's no telling what the charges will be when, or if this ever sees a jury. Go get a case of Snickers bars.

Do you think the release of the videos yesterday was an attempt to signal to the jury pool? It sure seems that way although with everyone digging into this, it could just be that a couple of FOIA requests were answered on the same day.
