The murder of Ahmaud Arbery

Lol shocking that Arbery’s immediate family has so many felons in it. I guess they didn’t take up jogging as a pastime?

Regardless, I still think McMichael jr will end up with a manslaughter charge. It will all depend on if a jury decides the fight for the weapon became an act of self defense. This is ugly no matter what.

Edit: just saw that charges came down.

Murder and agg assault. Seems like an overcharge just like Zimmerman case. I’ll have to read GA law on the agg assault

I'm surprised by the murder charge as well, but don't know enough about the law (let alone Georgia's) to dispute what the GBI came down with other than a very (limited) general understanding of what constitutes murder versus manslaighter.

Nonetheless, I do not believe that either McMichael will be convicted of murder.

They threatened him with firearms. Agg Assault would be the same in TN.
Murder in GA states intent and malice towards the victim. Don’t think that’s going to be provable. But I believe they are overcharging to “look tough” while knowing they probably won’t get a conviction
 
A murder charge is a good bargaining chip for a plea deal.
If I were the defendant I’d take my chances with a jury on that in heartbeat. There’s no way even with a hand selected jury that they would get a conviction on saying the suspect was shot with intent and malice by the son

I don’t know how it works and didn’t read it in the article, but I’m wondering if there’s a lesser charge of manslaughter attached to this. I think that was the case in the Zimmerman/Martin case, but they didn’t have video evidence like they do here to get Zimmerman on either. I do think murder 2 will be tougher to get. But I don’t know what I don’t know wrt this

If they don't plea, the DA will go to trial with manslaughter, agg assault, and maybe attempted agg kidnapping.

They hunted him down, and killed him. How is that not intent and malice?

If they weren't willing to kill him when they got in the car, what was the point in grabbing their guns?

99% of the posters in this thread know and agree it’s not premeditated murder. Grab a law book and understand some self defense as well. Mere possession of a firearm doesn’t mean you are looking to kill someone

I agree with RickyVol. unless you have direct evidence that they planned and meant to kill him, it will be an acquittal. Arguing that grabbing the guns isnt enough especially since the shots went off midstruggle and it's on video. The standard is Beyond all reasonable doubt. If agg assault is a felony then maybe Murder 1 is the charge by statute because a felony was also committed. I know that's true with false imprisonment not sure on agg assault
