The murder of Ahmaud Arbery

Manslaughter? IANAL but this appears to meet the criteria of felony murder. If I were those two boys, I'd be stocking up on soap on a rope.


1. This was an aggravated assault as defined below:
  1. The accused intentionally and unlawfully threatened, by word or act, to do violence to the alleged victim,
  2. At the time the threat was made, the accused appeared to have the ability to carry out the threat,
  3. The accused’s threat created in the mind of the alleged victim a well-founded fear that the violence was about to take place, and
  4. The assault was made either with a deadly weapon or with a fully formed conscious intent to commit a felony.

2. Aggravated Assault is a felony.


3. "A death that occurs during the commission or attempted commission of any felony constitutes murder”

Some quality father, son time. I do think they go for felony murder knowing they can at least get a manslaughter conviction depending on the jury. Can't rule out a plea deal down to manslaughter to avoid a trial. It will still p!$$ off a lot of people. I would think these two would be aware of public sentiment out there right now and should consider their options on a plea.

Yep, they are animals - and you are defending them.

At first I suspected you were simply playing the devil's advocate, and I can appreciate that. But when zero effort was being offered into making cogent or thought provoking paths, I had no choice but to assume your emotional investment clouded any sense of reason.

I agree, one way or the other - they'll be doing hard time. If they don't, lock up your daughters because Georgia will burn like Sherman was back on the scene.

Grey Wolf posted info from the autopsy this morning. Looks like three 3 shots, all from the shotgun. The first shot came before Arbery actually made contact with Travis McMichael and it grazed his wrist. Shots two and three came during the tussle and hit his chest.

Did McMichael Sr. ever fire his handgun? I saw/heard something alluding to that, but in the video you hear three gun shots and the coroner's report seems to state all wounds were the result of a shotgun.

I don't believe he ever fired. If he did, he didn't strike Arbery.

No he had it in the holster until Arbery attacked his son, but he never fired a shot

I believe the prosecutor is using the felony murder charge to hope they take the manslaughter charge, but if they don't, it will be interesting to see the court case/jury deliberating

I was kicked out of a church league basketball......game and league for “aggressive” play. I’m sure that will now be relevant to everything else that happens in my life from now on.
 
Do you think they armed themselves and pursued him because he had taken a gun to a basketball game one time with his gang? That would make a huge difference in this case. IMO.
If they new he had a history of having a gun and went after him instead of calling the authorities and staying out of the way then I think that reinforces murder.

Right on. Sometimes i too have to let them foo's know I was brought up on the mean streets of midtown memphis and if you weren't the one throwing Bill Laimbeer style elbows, you were the one catching them.

I was being facetious with that post, but nothing would surprise me anymore. Unfortunately thinking a guy shouldn't have been chased down and killed means you're an idiot that believes in monsters and dinosaurs.
 
What was really weird was that he was up in the bed of the truck like some kind of redneck sniper's nest.
Weird i've never seen a snipe with a handgun, but the moron was in that position because it's best to hold on if you are choosing to ride in the back of a truck without falling on your ass

The lack of thought from all parties would be comical if the outcome wasn't so tragic. I'm just trying to envision a scenario where I'd go with somebody to confront a jogger and end up riding in the back of a pickup while holding a pistol. It's just ludicrous.

No disagreement here, all three people in this scenario were dumbasses making dumb choices...

How's this going over in Macon? I was there when the Rodney King thing went down and everyone was driving around with guns assuming the whole place was gonna burn down. Of course, nothing happened.

I think you're probably a pretty reasonable guy, but this entire thing has played out fairly unusual. The man was killed and wasn't armed while being chased, the classic fight or flight. He tried to flee and they persued him and it got to the point where he felt the need to fight. The redneck white men need to be put in jail because they killed a man for no good reason.

It is a rite of passage for a man to get kicked out of church league game. I got kicked out as a player and a coach.
