Alito needs to recuse himself on all Trump cases. This kind of flag upside down crap just kills confidence in the Court's impartiality.
The same way Elena Kagan recused herself from the Obamacare case considering that she helped prepare the legal defense of the law as a member of the administration that wrote said law? Oh…..wait 😳
 
Not a question of "rules." No one could anticipate that you'd have to tell a Supreme Court justice not to fly a flag upside down to support an attempted insurrection.

If you have to have a rule for that, all is lost.

I knew of his disclaimer. It is irrelevant. The Justice should not have allowed it to happen.

And in any event, this nonsense of "replying to a neighbor with an anti-Trump sign" in their yard proves only that the wife (if that's who did it) intentionally flew the flag upside down in solidarity with the insurrectionists.

Much like Ginny Thomas, these wives need to b realize that what they say and do has repercussions to the appearance of political influence on their husbands. The fact that this is happening at that level is absolutely inexcusable.

I am not naive, I know judges have political identities. The good ones work hard to set those aside. Even minimally competent ones know that they keep their views (and the views of those closest to them) in close quarters for the very reason that if something like this happens, it undermines the confidence people have that the judiciary is fair.

Mrs. Alito should, IN PERSON, issue a statement apologizing and expressing deep regret at her extremely poor judgment. The Justice should, in no uncertain terms, disavow not just her actions but also her thinking and idiocy in terms of judgment.

and how exactly is MR Alito supposed to stop MRS Alito? You married on in a serious relationship with a woman? that doesn't go very well, ever. I imagine MR Alito has more pressing concerns than all the beefs his wife gets into.

I can tell you aren't married. His wifes rights dont end at his swearing in. And they shouldn't. And I'm 100% ok with any judge expressing their political beliefs. I expect them to do their best to do what they've sworn to. I'd rather have all biases out in the open.

And despite your insistence, an upside down flag is not a sign of supporting an insurrection.

The U.S. flag code states that the flag should not be flown upside down except as a “signal of dire distress in instances of extreme danger to life or property.”

So if you guys are okay with the wife of a Supreme Court Justice desecrating our flag, I guess there isn't much to talk about.

I'm not bothered by the wife of a Scous justice celebrating her constitutional rights. I hope she owns firearms too.

She has a constitutional right to desecrate the flag, you are correct.

Doesn't mean that so-called "conservatives" should be okay with it. Maybe the RINO tag has been placed on the wrong toe.

I've never had a problem with someone setting one on fire in protest either. Its all part of our guaranteed and protected rights. You are a threat to those rights.

It was an entirely partisan display by the household of the guy who might have had to rule on who was president.

Downplay it if you want, but it's a bad look for the idea that the court is above politics.
