Tony Basillio confirmed - Kevin Ware won't be released

I'm sure the 'AA will get right on adding an amendment to the LOI, so you can get out of it that states, "If you are lied to during the process of your recruitment, even after you sign your LOI, you can ask for and receive your release for the school you signed with.". Every college basketball coach in America would be laughing at that, even the football coaches would be as well.

Since you are harping on this being a contract so much, you should probably consider that a material misrepresentation that is relied upon by one of the parties can invalidate a contract. I'd say lying about who the coach will be probably constitutes a material misrepresentation. Just a hunch though.

Everyone should be allowed the free will to do what they want. But tickets, play ball, lie to those buying tickets and playing ball. But, in any advanced culture, the ones that chose to play ball ball and buy tickets should not be dragged down to the standards of those who chose to lie.

And what was in the LOI that has changed or been misrepresented??

Thanks. My year of law taught me something.

So, would Ware be considered a liar, especially given his previous pledge and signed LOI, if he chooses to go elsewhere??

I know of 5 people that wouldn't spend the money on club seats this year, just because they would have had to pay for every game, even if they didn't play them.

What the Hell is the point of this? No one is holding a gun to their head forcing them to buy the tickets.

BTW, show me in ANY LOI, where it's guaranteed who the coach will be??

Nobody is arguing the language of the LOI itself. The argument consists of whether it's right to hold a player and make him sit out a year, even if the circumstances when he signed it are completely different than they are now.

This isn't a Kevin Ware problem. This is a problem because Mike Hamilton personally reassured Ware that Bruce Pearl would be the coach for a long time.

Yet, they had to buy them to stay in those seats. I'm talking about people who have been at LP since the beginning. Sports are always about the fans, because without them, who would watch??

Then why not let everyone in for free, if they aren't forcing people to buy tickets without the guarantee of the season?? I know of 5 people that wouldn't spend the money on club seats this year, just because they would have had to pay for every game, even if they didn't play them.
You mean they exercised free will and made a decision on whether or not to risk buying tickets? What a novel concept.

So, maybe Haslam and the power brokers should call Ware then. Hammy was Pearl's biggest supporter, all the way to the end. Hammy even tried to throw himself on the knife, just to save Pearl, I have heard.

Is it fare though that a fan has to buy something, just to be guaranteed it, even if there isn't a game to watch and yet still have to pay NOT to watch that game because it's not being played?? Tell me that fair.

Yeah, that explains why Mike Hamilton went on the radio the day before the NCAA tournament and threw CBP under the bus.

You buy knowing there may not be a season. You know, like signing a Letter of Intent knowing the coach may leave or be fired.

Rumor has it a certain coach now at Kentucky used to put in an out-clause for his recruits in case of this exact situation. He gets fired and/or leaves, the out-clause terminates the LOI.
A loophole the NCAA has since expressly closed.

It obviously did not teach you to be civil by calling me an idiot. All I was saying, is that hat was going a little to far, throwing around massa and the 13th Amendment and suddenly I am an idiot. Get real dude....

Sorry, man. That was uncalled for and I apologize.

You clearly have no clue about contracts. Suffice it to say that there are numerous ways in contract law that Ware would be able to get out of this.

And what governing body would he go to to get the 'AA LOI dissolved?? This all seems like a huge undertaking for a kid who was all convinced he was coming here.

All he said was he was unsure if Pearl would be our coach. He didn't throw crap under the bus. Pearl drove the damn bus over himself.

He could have said nothing, but he didn't. He answered the question and raised doubt that Pearl wouldn't be the coach, even after he had told Ware that BP was going to be the coach.

It's not illegal to do that, at least not to the NCAA. However, it's a pretty janky(yeah, I used that word) thing to do, and could have negative repercussions going down the road.
