I don't know, did we have legal and illegal immigration in the 1860's? It looks like the State Department says we codified diplomatic immunity in 1790, page 13 of the following.I was reading and referring to the 1866 version that was ratified in 1968. The one written for a specific purpose. Not the one's updated to circumvent illegal entry. Not any abominated version since. There was no diplomatic immunity in 1868. The original 14th in no way, shape, or form contained language that allowed for illegal entry in order to facilitate a birthright citizen.
However, I am of the opinion that you have to couple the 14th with immigration laws on the books to review and award birthright citizenry. A person crossing the border illegally, hence a criminal, should not be granted rights to birth US citizens. However, I would not object to permanent, card holding, resident aliens having that right protected.
