UT under potential NCAA investigation for NIL

😂 Ok. Their stance is pretty damn irrelevant if this goes to court. Plowman already drew a line in the sand this is going to court if they pursue it. NCAA doesn’t want any part of that.
The NCAA knew it would be litigated before they made the allegations yet they decided to pursue it anyway. Maybe it’s a desperate attempt or maybe they believe they can win the argument in court.

I actually believe it is a solid argument. Booster Collectives like The Volunteer Club fund raising millions and then paying recruits guaranteed money under the guise of NIL isn’t at all what was proported when the courts ruled in favor of NIL.

How did it work out for them when they got sued over transfer rules?
 
It’s cute that NCAA and other fanbases are acting like NIL deals are not used to recruit players to schools. Remember when Stoops was lamenting the lack of NIL money for his team and how he needed to “buy” better players like UGA did? Kentucky fans having a field day on social media about todays news seem to forget they aren’t being looked at because their trash program can’t even get enough money to get good players. Their own coach said so.

I think this is a very interesting take on the situation. I won’t pretend to have a firm grasp on what is actually happening bc it looks like a freaking huge mess.

It kinda appears that the NCAA is desperately attempting to use TN to set some precedent. They think they have something with the Nico situation and they are hoping that their position is strengthened by the ruling that took place months ago. They are hoping that TN will fall in line and play nice again, but that doesn’t appear to be the case this time.

Saying that TN and the Spyre collective are guilty of inducing players and tampering with players at other programs appears fruitless. Is TN doing this? Is the Spyre collective guilty? Yeah, they probably are, but is what they are doing drastically different from what other programs and collectives are doing? Absolutely not!!! And the NCAA is as guilty as anyone for creating this new atmosphere where these things are happening. It’s been the Wild West for awhile now.

And for the moment it looks as though TN and Spyre are not going to take it. Plowman took a strong stance and Spyre can apparently deny any wrongdoing by themselves or the program. They aren’t rolling over, they are telling the NCAA to take a long run off a short pier. And honestly, with the way this looks, I say good for them.

I’m not sure where this ends up, but I absolutely do not think that Plowman is just posturing, nor is Spyre. They see what a predicament that the NCAA has gotten themselves into, and they aren’t about to be made an example of or be the scapegoat.

They got Downs a day after he entered portal, and his NIL had already been done. I’m sure it’s all above board though. They got lucky that Judkins didn’t get the money he’d thought he’d get , they got him at a discount rate when he learned he wasn’t worth what he thought. He pulled a George Costanza and negotiated for LESS money.

They should hire Lou Holtz for that OSU investigation.

NIL was never litigated. Alston v NCAA was about scholarship educational benefits, not NIL. The NCAA saw the handwriting on the wall after that and changed their NIL policy.

Everyone knew what NIL would quickly become and that's why IMMEDIATELY players like Bryce Young were projected, correctly, to become millionaires.

There is no controlling NIL at any level for anyone, not just athletes, in America. Who sets a limit on what Pete Rose can charge for his autograph? That would be...... no one except the market. There's no "set value" that is "enough" for someone's NIL except what people will pay. I assume you love America? That's how it works.
 
if the NCAA really wants to take this fight on they are going to be destroyed. This will be a drawn out 1-2 year battle. Secondly it will go to the courts. NCAA is violating antitrust laws and the the ability for persons to maximize earning potential. NCAA would be crushed in court.
Yeah, but that's the end of college sports. It's not actually in UT's interest to have the NCAA lose the Antitrust Law issue, so they don't want to go that far.

The replacement for the NCAA is most likely some kind of pro league because any attempt at saying players won't be compensated is, again, in violation of Antitrust Laws.

So, hoping for the NCAA to get crushed by the courts on Antitrust Laws probably isn't what you want to see either.

NCAA has not made any allegations. That is the point of Donde’s letter - to suggest that the NCAA leadership bring their enforcement division to heel before the situation gets out of hand.
 
It's getting freaking old. In the news with the NCAA barking at our door for the last 15 years.
Will ESPN run the timeline every game Tennessee has broadcast like the Pearl deal.
Kansas skates, Michigan skates, LSU skates, UNC skates....

NIL is the Wild West, there were very few “rules” in place when it started. Each state has adopted their own laws and now the NCAA is trying to reign things in and remain relevant. Good luck in court with that, you can’t put the genie back in the bottle now. The NCAA is on its way to irrelevancy. Time for the top 50 schools to form their own super conference and appoint their own commish.

It's apparently over an NIL "violation" that Spyre arranged a plane for Nico during recruiting.

I don't know how they even define a recruiting violation anymore with the NIL and apparently the NCAA is having trouble with it as well.
I think that’s the rub. NCAA won’t engage in a membership-wide discussion about what is allowed and what isn’t.

There's been a shifting standard and instead of functioning to develop something workable, they’re arbitrarily picking which standard to apply. Sounds like that’s even a violation of its own bylaws.

Hell, it might even amount to bad faith which could render any obligation on UT null and void.
