Vaccine or not?

Businesses will be in the clear. Legally they were fine. Morally they are POS.

Glad I don't work for one who tried to mandate that nonsense. My wife stood her ground on her mandated vaccine, and they finally quit bothering her.

I would say that I think I have treated the opposing side with respect and have tried to provide a factual basis for any arguments that have been made....
As have I. It is fairly apparent that some people are just unable to treat others with respect. They are generally the same type that refuse to admit they have been wrong, made a mistake, or were fooled.

I could see some cross examinations being entertaining.

Mr X you claim your religious beliefs prevent you from taking this vaccine?
Yes.
Doesn't your religion also prohibit adultery?
Yes
Then can you explain these pictures?
This is going to destroy a lot of people.
“What other vaccines have you taken, and can you explain how your religion differentiates between them?”

Not really, people can not be religious and become so at any point in their lives. They can also become better informed about things and realize they go against their beliefs. Protected religious freedom in this country is a very good thing.

Less than 1% of Americans practice a religion that has anti-vax as part of their doctrine.

I had an employee try to claim religious vax exemption for COVID the day after she got a flu shot...

If you are injured on your way to work is your employer liable for making you come to work?

As a business owner, if one of my employees are injured as a direct result of a policy change that I mandated then I absolutely should be held responsible. Over the years we have seen businesses sued for far less. I recall a lawsuit where McDonald's got sued for their coffee being to hot.

So if you had remote workforce and now you are making them come back into work, you are liable for them driving into the office?

If an employee gets injured due to the direction of the employer, they're liable. It's well documented that you supported the right of employers right to enforce vaccine mandates. Luckily, you most likely were just being dumb on a message board and didn't enforce it on your employees. Be happy.
Keep in mind you were responding to someone who believes employees should be completely subservient to their employers, wants to legalize all hardcore drugs, and probably wishes Robert E Lee would rise from the ashes and run for president. Then claims he is some kind of conservative. Nothing conservative or even libertarian about believing businesses can just force whatever they want unto their workforce.

Is your office on a desert plateau that was only accessible by cartoon roadrunners and did you buy a prefab bridge from Acme corporation and have it assembled by a cartoon coyote?

I'm aware of his views as and employer.

Yes but you can still be taken apart in court if you’re lying about those beliefs and your actions do match your claims.
The red women is a retired nurse who is now a medical paralegal for a personal injury law firm. We’ve had these discussions at length. It’s going to be really interesting to see how this shakes out.

No, they are hourly W2 employees driving to work.

Are you responsible if they get a speeding ticket driving to work or getting a ticket for texting while driving to work?
No, but if I direct them to have a sex change as a requirement of employment and then fire them, is that wrongful termination? We can have apples to apples ridiculous comparisons all day.

I have a good friend who was opposed to taking the jab. He was told to take it or loose his federal job of 30 years. I can't tell you how many times he has caught covid in the past 18 months.

Your health records will be part of discovery. Your kids health records will be part of discovery. Questions about your church will be asked during a deposition. Your social media will be part of discovery.

That probably falls under some gender protection so yeah, you could probably sue...

You could get a medical exemption too...

I do not think people should have a religious or medical exemption from the vaccine. I think "I do not want to take it" or "it is none of your damn business" is enough of an exemption.

And many businesses were that way. Some couldn't be because of business with govt.

One issue you will see, IMO, are companies not applying the rules consistently. Some companies will look at good employees and not investigate any exemptions while granting them while they will do full investigations of exemptions for average or mediocre employees...

The key words are "direct result". Is driving into my office a direct result of my policy change? Sure, it wouldn't have happened had I not made them drive to work, but it also probably wouldn't have happened had they been more careful. If I force my employees to take an EUA drug and they can prove that their health was damaged as a direct result of my mandate, they should absolutely sue me. The only way they could have avoided this was to choose not to take the jab and loose their job
