Yemi granted release. (order of protection taken 4/22)

This isn't a criminal matter, it's a civil matter (as long as he doesn't violate the OP).

OPs are ordinariily issued on an "ex parte" basis: an accuser goes down to Fourth Cir. Court and fills out a Petition. So long as there are proper allegations of domestic abuse, sexual abuse or stalking, Judge Bill Swann will sign an "ex parte Order" ordering the accused not to go around the accuser without any hearing on the facts. The actual hearing on the matter is set for no more than 15 days from the date on which the petition was filed.

These OPs carry with them a civil burden of proof as opposed to the much higher criminal burden (beyond a reasonable doubt). Ordinarily, the Fourth Circuit Court is very pro-Petitioner, and OPs are fairly easy to get. I wouldn't really worry about this too much. I doubt that an OP is the reason Yemi is leaving.

I really don't care that Yemi is leaving but he is being replaced with more deadwood.

The point is you get on here almost daily and attack people because they do not agree with you. You constantly ask for "links" as part of your smart arss way when you yourself post rumor and speculation all the time - and "things you heard".

I'm in Fourth Circuit Court more than I care to admit (purely business). "Order of Protection" sounds big and bad, but if I shared all the weird situations in which the Court awarded them, you'd be really surprised.

That's interesting. I don't know anything about the law but I always thought you had to do something serious to be granted an order of protection. And then I thought the police had to be involved as in an arrest or something like that.

Either way, If the young man indeed tried to rape a girl, he should get into trouble. Likely, nothing comes out of this and we won't hear much about Yemi anymore.

All depends on your definitions of the word "serious". Allegations of sexual abuse are serious in any respect, but it's important to understand that the burden of proof here is not very high.

If girl is going to take the stand and say it happened, and Yemi is going to take the stand and say it didn't, the Court is going to weigh the credibility of each witness. If there's not a discernible difference, the Court would most likely err on the side of caution and grant the OP just based on the severity of the allegations. Very pro-petitioner.

Try being in the city of Memphis for OP hearings. Awful, awful, awful.

I am a criminal defense attorney and will rarely take them.

I can imagine. They're easier to take with the more lenient "attorney's fees" provisions in the statute, but even with the new provisions, the majority of people who get charged with OPs can't afford a private attorney to defend them.

Does not have to involve a criminal case, while some certainly do. There are so many in Memphis that you do have to have some decent proof to get one.
 
Would tend to agree but this doesnt appear to be the case here.

'According to Knoxville Police Department spokesman Darrell DeBusk, Knoxville Police responded to the initial incident before handing the case off to the University of Tennessee Police Department.'

She filed the OOP and that appears to be the extent. Unless I missed something.

He apparently held her down and attempted to have sex with her. So, it does appear to be the case if she would've filed criminal charges. For whatever reason, she chose not to.
