'09 TN DL Daniel Hood (merged)

Even if it were a prank gone bad, the rape still took place. No excuse is acceptable. What concerns me more is reading the assesments on this kid. In twenty years of working these type cases I have never witnessed a "converted sex offender". The risks in this situation far outweigh the reward.

*sidenote I have asked the Lord's forgiveness for the above post!

The rape took place and he was convicted of the rape, but he did not actually perform the rape from the facts in the opinion of the court. The older boy did that and this kid just did not stop it and watched. That is bad, no doubt. But it is different than actually performing the act. The older kid got 10 years in prison. This kid was probably spared that sentence partly because of his age but also because he was not the one who actually comitted the act of rape and because it started as a prank instead of premeditated rape.

i don't care how old this kid was at the time, he was complicit in the rape of his own cousin and that is unforgivable. for those of you saying that he was just a kid or just being a follower that is a cop-out and no excuse for his actions. rape is wrong no matter how old the raper is, and follower's still have to choose to follow. he obviously knew what he was doing was wrong by his statement when asked if he wanted to physically participate in the rape that "no man that's my cousin" so i have absolutely no respect or willingness to root for this little punk.

You are an idiot.

Put the uniform on and walk in his shoes before you call him an idiot. My idea of an idiot is someone who gets paid to defend a person that they know is guilty of a crime, no matter how horrible the crime. I have seen defense lawyers call rape victims liars, and have them in tears on the stand, trying to get their POS clients out of a charge. So dont go there!

Look, the kid did not rape anybody. He was there when it happened and did not stop it. That is a big difference in actually raping someone, especailly when this started as a prank on his cousin and went too far. You guys act like he went out and abducted someone and then personally raped her. Those are just not the facts.

He is just as guilty as the other guy. He was there and conspired with his friend to do this.

This is crazy...this shouldn't even be an issue for Tennessee and don't give me the age excuse. He was 13 and knew exactly what he was doing.

I would say his cousin may have a different take on it, but hey I'm a idiot.

I don't know exactly how this kid will fit in with the rest of the team. The fact that he is a convicted rapist and the fact that he got on the team through bureaucratic means are potentially polarizing issues in the locker room.

Well it's either forgive and forget or hold a BAD mistake against this kid and tell him that no one is going to support him and let him know that he can't make it. Whether or not we agree with it, I can tell you that the football team itself will watch him like a hawk and the first sign of trouble it will be dealt with. That is if this is true.

That's for his family to do. Not the University, not the coaches.

Forgive and forget? Do you think that little girl will forget.

I would be VERY disappointed in CLK and staff (not to mention the University) if this turns out to be true.

Are you defending this guy?

Yes you are. It is not wise to start telling people to stfu. Everyone has the right to an opinion and yours is no better or valid than mine.
Now lets not get carried away...there are those in prison for this exact same thing that would strrongly disagree with you.

So penetrating her with a toilet plunger (while duct taped helpless) isn't a bad thing in your opinion?

He DID abduct her. Tied her up with duct tape and held her against her will.

That's where we will just have to agree to disagree. I don't think from the facts that he is "just as guilty as the other guy" who actually raped the girl. I am not just talking about the legal definition of guilty (the guy who is driving the get away car is guilty of murder if the bank robber shoots the clerk). I am talking about guilty in a moral sense and punishment sense.

Correct. But based on these facts he did not get the 10 year sentence that the older boy got who actually raped the girl. There is a good reason for that. READ the facts.

You may want to go and actually READ the facts. He never penetrated her with anything. That's my point.

I did read it.

Trash like you garners an immediate ignore. And yes, in this case, your opinion does show your character.

I don't know anything about this kid other than what I just read about him. Regardless, I'm all for giving someone a second chance. Many people would not be where they are today without someone giving them a second chance.
