This will almost certainly all be blown off, and in two or four years, we'll be discussing the same thing all over again. The simple reason is that to fix a problem, you first have to admit there is a problem ... and our government is never wrong. So, yes, the courts will refuse to hear "anecdotal" evidence because no one wants it to be anything more than anecdotal, and a real look just might find dirt under the carpet.
