Speaking of that, I keep waiting on some really clever lawyer (not EL of course) to try and get a conviction thrown out on “anything you say can AND WILL be used against you in a court of law”. The word WILL is critical. They should have used the word MAY. A strict reading of the phrase requires EVERYTHING you say to be used in the prosecution’s case. So if I am arrested for bank robbery and I tell the arresting officer “my cousin’s roommate’s pet duck drives the Zamboni at the Predators games every second Tuesday of the month”, the state is OBLIGATED to use that against me. If they don’t, they have to let me walk, right?
